A. Lease Agreement with T-Mobile West Tower LLC by and through
CCTMO LLC - Authorize
Property and Acquisition Analyst, Cheryl Rolcik-Wilcox presented details
about a lease agreement the City entered into on September 23, 2005, with
a predecessor of T--
operate a wireless communications facility at the Pump Station No. 5 site,

located at 23825 98 Avenue South in Kent. That lease agreement expired
on September 26, 2020 and converted to a month-to-month term payment.

Rolcik-Wilcox advised that T-Mobile has requested to enter into a new lease
which would retroactively commence on September 27, 2020 and end on
September 30, 2025 with an option to renew for two additional five-year
periods. Rent will start at $2,800 a month and will be adjusted to market
rent during the first year of each renewal term. Rent will increase 4 percent
years two through five of the initial term and each renewal term.
MOTION: I move to authorize the Mayor to execute a lease
agreement with T-Mobile West Tower LLC, by and through CCTMO
LLC to operate and maintain a wireless communication facility at

B. Termination of Drainage Easements and Sidewalk Easement on
Bridge Point Kent 300 LLC Property - Authorize
Property Acquisition Analyst, Cheryl Rolcik-Wilcox presented details from
Bridge Development Partners LLC who is re-developing the former REI
property. The developer has requested the City terminate two drainage
easements granted to the City in 1987 that are located on the property in
order to construct new buildings in the existing easement area and to convert
the drainage system on the property from public to private. As part of the
agreement the Developer also agreed to build a new sidewalk and planter
strip with street trees, and dedicate as right-of-way the area where a
sidewalk easement was granted to the City in 2012, is currently located.
MOTION: I move to authorize the Mayor to sign terminations of two
drainage easements and a sidewalk easement on property owned by
Bridge Point Kent 300, LLC subject to final terms and conditions
acceptable to the Public Works Director and City Attorney.

C. Environmental Covenant with State of Washington, Pollution Liability
Insurance Agency and G/R Meeker Street LLC - Authorize
Public Works Director Chad Bieren presented a drawing of the intersection of
64th and Meeker that included the Midtown 64 Apartment complex, built by
Goodman Real Estate (G/R Meeker). There is a portion of the G/R Meeker
property that had been contaminated decades ago by an underground tank

located at a former Shell Station. The contamination made its way across the
street from the Shell site, underneath Meeker Street and onto the G/R
Meeker property. G/R Meeker removed the soil, cleaned up the area and
installed an activated carbon wall in a portion of the right-of-way, which
prevents further pollution of the property. A limited license agreement was
entered into with the City and G/R Meeker.
As part of the process of getting the property released they need to have an
environmental covenant that restricts certain activities and uses of the G/R
Meeker Property and the portion of the right-of-way containing the carbon

wall. Bieren went on to explain the benefit of the covenant to the committee.

covenant with the State of Washington, Pollution Liability Insurance
Agency and G/R Meeker Street LLC, subject to final terms and
conditions acceptable to the Public Works Director and City Attorney.

D. INFO ONLY: Residential Traffic Calming Program Update
Transportation Engineer Honey Maria presented an update on the Residential
Traffic Calming Program (RTCP). Maria noted the program was updated in
June of 2020 to better address neighborhood livability concerns and noted it
continues to be a popular program among residents. There were 44 traffic
calming requests in 2020 and 23 in the first eight months of 2021.
Below is the status of the program and the number of request in each part of
the program:
· 20 New RTCP requests
· Staff scheduled new traffic studies as traffic conditions have settled into a
the COVID pandemic.
· Staff closed out 21 RTCP requests that do not meet the minimum
requirements to install traffic calming devices.

SUBJECT: INFO ONLY: West Hill Reservoir Update
SUMMARY:
Staff will provide an update on the construction of the West Hill Reservoir located at
thth
38 Ave S. and S. 248 Street. Site prep work, site utilities and the foundation
have been completed. Steel panels that will make up the sides of the tank have
been delivered and the contractor is constructing the vertical side walls of the tank.
Once complete, a painted mural is planned for the water tank. A request for
proposals was advertised in August for mural contractors. One proposal was
received from an experienced northwest contractor. The contractor will be retained
to provide mural renderings that will be presented to the Kent Arts Commission,
West Hill Neighborhood Council and interested individuals for feedback. After that
process, we will return to the Public Works Committee for concurrence.

SUBJECT: INFO ONLY: NPDES Audit by the Department of Ecology
SUMMARY:
The City is permitted by the Washington State Department of Ecology to discharge
stormwater into streams, lakes, wetlands, and the Green River. This permission is
granted under the Western Washington Phase II Municipal Stormwater Permit
(Permit). The Permit is required by the Federal Clean Water Act, with specific rule
making under the National Pollutant Discharge Elimination System (NPDES).
The Permit requires the City to implement Stormwater Management Programs that
manage and control stormwater runoff to prevent downstream pollution. Public
Works is responsible for ensuring that the city implements stormwater management
practices consistent with Permit requirements.
Staff will present a brief overview of the Permit, including new program
requirements and an update on Permit implementation in Kent. A summary of the
