Call to Order Chair Bill Boyce called the meeting to order at 6:03 p.m. 2. Roll Call Chair Bill Boyce, Councilmembers Satwinder Kaur and Marli Larimer in attendance. 3. Changes to the Agenda There were no changes to the agenda. 4. Minutes dated May 17, 2018 MOTION: Councilmember Kaur moved to approve the minutes dated May 17, 2018. Councilmember Larimer seconded. The motion passed 3-0. 5. First Amendment to the 2017 Annual Action Plan –Recommend The Parks Department Human Services division has recaptured funds from 2017 CDBG Plan and requesting the Committee to recommend to City Council the reallocation of $20,964 in public service funds. Fifteen percent of the allocation would go to the public service funds and reallocate to a public service project in 2018 that has not been previously funded and address an emerging urgent need of an underserved population. There is also $75,947 in planning and administration funds that the Human Services division is requesting the Committee to recommend to the City Council to reallocate planning and administration budget for 2018. Addendum: A corrected version of the First Amendment for the 2017 Annual Action plan was given out at the meeting. The correction is on packet page 7, D.1 (Parks/Human Services Council Committee Packet). The amount is $20,964 instead of $19,440. Council member Brenda Fincher, Director JulieParascondola, and the Deputy City Attorney Tammy White were notified before the meeting, however, in error, the correction was not mentioned at the meeting. MOTION: Councilmember Larimer moved to recommend Council approve the Proposed Fist Amendment to the 2017 CDBG Annual Action Plan and authorize the Mayor to submit the amendment to HUD. 4.A Packet Pg. 3 At t a c h m e n t : P & H C o m m i t t e e M i n u t e s 1 8 0 6 2 1 ( 1 3 1 1 : M i n u t e s S u m m a r y , d a t e d 6 / 2 1 / 1 8 ) Page 2 of 3 The motion passed 3-0. 6. Second Amendment to the 2016 Annual Action Plan – Recommend The 2016 Amendment to the Action Plan has recaptured funds in the amount of $27,740 in public service funds, $81,564 in capital funds and $67,137 in planning and administration funds. The request of the Committee is to recommend to counsel to allow allocation of these funds as listed: $27,740 from the public service funds to an emerging needs fund in 2019. $81,1564 from the capital funds to the Home Repair Budget $35,000 of the $67,137 planning and administration funds to purchase a new truck for the Home Repair Budget with the remaining balance allocated to the administration budget. MOTION: Councilmember Kaur moved to recommend Council approve the Proposed Second Amendment to the 2016 CDBG Annual Action Plan and authorize the Mayor to submit the amendment to HUD. The motion passed 3-0. 7. Jan. – Apr. 2018 - Fee-in-Lieu Funds – Recommend Correction in the motion was handed out to the Committee members. There was confusion as to which Fee-in-Lieu went to which park. As a result of three different small developments, Parks Planning and Development division received $33,225 in fee-in-lieu funds. The request of the Committee is to recommend to counsel to allow allocation of these funds to Chestnut Ridge Park, Clark Lake Park, and Morrill Meadows Park. MOTION: Councilmember Larimer moved to recommend Council accept $33,225 of fee-in-lieu funds, amend the Community Parks Reinvestment Program budget, and authorize the future expenditure of these funds for capital improvements at Clark Lake Park, Chestnut Ridge Park, and Morrill Meadows Park. The motion passed 3-0. 8. Recreation and Cultural Services Overview – Information Only Lori Hogan, Recreation, and Cultural Manager shared with the Committee a summary of the City’s Recreation and Cultural Services responsibilities, to educate and inform the Committee and to allow for any questions to be answered, as well as open dialogue and discussion. Addendum: Page 16 Sub-bullet Under Bullet "Budget reductions for 2019-2020". Director's Report – Information Only The New Summer Concert Series is out The Splash event is coming up this 4th of July Will be breaking ground sound on the new Kent YMCA New release went our regarding the relocation of the Dog Park at Morrill Meadows. August 21 at the City Council Work Shop both Parks Director Julia Parascondola and Deputy City Attorney Tammy White and YMCA will present a post agreement update and RCO conversion. 10. SUMMARY: Each grant cycle (every other year) Parks staff pursues funding for park development and/or acquisition of property through the Washington Recreation and Conservation Office (RCO). Parks staff is requesting authorization to submit a grant application to the RCO’s Land and Water Conservation Fund program to help fund the West Fenwick Park Renovation project. Resolution for RCO Grant App #18-2207 (PDF) 6 Packet Pg. 7 1 West Fenwick Park Renovations— Application to Recreation & Conservation Office Land and Water Conservation Fund, Outdoor Recreation Legacy Partnership Program RESOLUTION NO. _______ A RESOLUTION of the city council of the city of Kent, Washington, that: (1) authorizes the submission of an application for grant funding assistance through the Land and Water Conservation Fund Outdoor Recreation Legacy Partnership Program of the Recreation and Conservation Office, as provided for in Chapters 79A.15 and 79A.25 of the Revised Code of Washington, Chapter 286 of the Washington Administrative Code, and other applicable authorities, for renovation of West Fenwick Park, and (2) identifies the Parks Director as the City’s authorized representative for purposes of securing the grant and binding the City to the grant’s terms and conditions. RECITALS A. The city of Kent has approved a comprehensive parks and recreation or habitat conservation plan that includes capital improvements at West Fenwick Park. B. The city of Kent considers it in the best public interest to complete the project described in the application. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: RESOLUTION SECTION 1. – Intent to Apply. The City has applied for or intends to apply for funding assistance managed by the Washington State Recreation and Conservation Office (“RCO”) for the West Fenwick Park Renovation Project (“Project”). SECTION 2. – Authorized Representative. Julie Parascondola, the Director of the City’s Parks, Recreation, and Community Services Department or her designee (“Parks Director”), is authorized to make formal application to RCO for grant assistance. The Parks Director is the City’s authorized representative who has full authority to bind the City regarding all matters related to the Project, including without limitation authority to: (1) approve submittal of a grant application to RCO, (2) sign any amendments to the Project Agreement approved by the Mayor, (3) make any decisions and submissions required with respect to the Project, and (4) designate a Project contact to implement the day-to-day management of the grant. SECTION 3. – Project Agreement. The City has reviewed the sample Project Agreement on the Recreation & Conservation Office’s web site at http://www.rco.wa.gov/documents/manuals&forms/SampleProjAgreement. pdf and authorizes Dana Ralph, the City’s Mayor, to enter into such Project Agreement, if funding is awarded. Once signed by the Mayor, the Project Agreement will be legally binding on the City. The City is aware that RCO reserves the right to revise the Project Agreement prior to execution, but RCO has agreed to communicate any such revisions with the City’s authorized representative prior to the Project Agreement’s execution. SECTION 4. – Legal Authority. The City acknowledges that with adoption of this Resolution, the city council has granted the Mayor and the City’s Parks Director the authority necessary to enter into the Project Agreement on the City’s behalf without further Council approval, which Project Agreement will include indemnification, stipulated legal venue for lawsuits, and other terms and conditions substantially in the form contained in the sample Project Agreement, or as may be revised prior to execution. SECTION 5. – Use of Funds. Any grant assistance received will be used for only direct eligible and allowable costs that are reasonable and necessary to implement the Project. SECTION 6. – City Match & Non-Cash Commitments. The City expects its matching share of Project funding will be derived from City funds and that pursuant to WAC 286-13-040 the City must certify the availability of match at least one month before funding approval. In addition, the City understands it is responsible for supporting all non-cash commitments to this Project should they not materialize. SECTION 7. – Grant on Reimbursement Basis. The City acknowledges that if the RCO approves grant assistance for the Project, RCO will pay the City on only a reimbursement basis. The City understands reimbursement basis means that the City will only request payment from RCO after the City incurs eligible and allowable costs and pays them. SECTION 8. – Dedication in Perpetuity. The City acknowledges that any property owned by the City that is developed, renovated, enhanced, or restored with grant assistance must be dedicated for the purpose of the grant in perpetuity unless otherwise allowed by grant program policy, or RCO in writing and per the Project Agreement or an amendment thereto. SECTION 9. – Resolution – Part of Application. This resolution becomes part of a formal application to RCO for grant assistance. SECTION 10. – Certification. The City certifies that this resolution was properly and lawfully adopted following the requirements of the City and applicable laws and policies and that the person signing as authorized representative is duly authorized to do so. SECTION 11. – Effective Date. This resolution shall take effect and be in force immediately upon its passage. SUMMARY: In May and June of 2018 the city of Kent received a total of $58,275.00 from the following developers, who voluntarily paid a fee in lieu of dedicating park land to mitigate the development of homes in local subdivision.
