HomeMy WebLinkAbout1881RESOLUTION NO. / 'YT/ A RESOLUTION of the City Council of the City of Kent, Washmgton, determm1ng a new threshold amount for the sales and use tax authonzed by RCW 82.14.415 and cod1f1ed In Chapter 3.27 of the Kent City Code, relat1ng to the cost of prov1dmg municipal serv1ces to the Panther Lake Annexation Area for the 2014 f1scal year, and authonzmg the Finance Director to cert1fy the threshold amount to the Washington State Department of Revenue. RECITALS A. RCW 82.14.415 authonzes the City to impose a sales and use tax as a credit agamst state reta1l sales and use taxes collected under Chapters 82.08 and 82.12 RCW to ass1st the City m prov1d1ng mumcipal services to newly annexed areas. I B. After providing all appropriate notice and following appropriate procedure, and followmg a favorable vote on the annexation proposition, the Kent City Council adopted Ordmance No. 3936 on December 8, 2009, approvmg the Panther Lake Annexation Area effect1ve July 1, 2010. The population w1thm the annexation area determined at the t1me of annexat1on was 25,458 people. 1 Tax Credit Threshold Panther Lake Annexation C. On February 16, 2010, the City Council passed Ordmance No. 3947, creating Chapter 3.27 of the Kent City Code and 1mposmg the sales and use tax at the rate of 0.2 percent. D. On February 15, 2011, the City Council adopted Resolution No. 1839 confirmmg the tax rate at 0.2 percent and authonz1ng the fmance director to cert1fy the threshold amount for the 2011 f1scal year. E. On February 7, 2012, through Resolution No. 1853, the City Council adopted a new threshold amount for the 2012 fiscal year and authonzed the fmance director to cert1fy the same. F. On February 19, 2013, through Resolution No. 1871, the City Council adopted a new threshold amount for the 2013 f1scal year and authonzed the fmance director to certify the same. G. With th1s Resolution, the City authonzes the 1mposit1on of similar annexation sales and use taxes for the 2014 f1scal year. H. The City Council of the city of Kent, Washmgton, fmds and determines that the projected cost to prov1de municipal services to the Panther Lake Annexation Area for the 2014 fiscal year Will be at least $11,949,899, and that th1s cost exceeds the proJected general revenue that the City would otherwise receive from the annexation dunng the 2014 f1scal year, wh1ch 1s estimated to be $7,719,122. I. Pursuant to RCW 82.14.415, the city of Kent is authorized, under the circumstances of this annexation, to 1mpose a sales and use tax for the 2014 fiscal year, which shall be collected by the State department of revenue from those persons who are taxable by the state under 2 Tax Credit Threshold Panther Lake Annexation Chapters 82.08 and 82.12 RCW, upon the occurrence of any taxable event w1th1n the City. J. The rate of tax imposed shall be 0.2 percent, and shall be in addition to other taxes authorized by law, and the threshold amount for the 2014 f1scal year 1s $4,230,777. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: RESOLUTION SECTION 1. -Rate and Threshold Amount. The Kent City Council determ1nes that the threshold amount for the City's proJected net cost m providing mun1c1pal serv1ces to the Panther Lake Annexat1on Area for the 2014 fiscal year is $4,230,777. The City Counc1l prev1ously 1mposed a sales and use tax at the rate of 0.2 percent, w1th the passage of Ordmance No. 3947 on February 16, 2010. SECTION 2. -Implementation and certification. The Mayor of the c1ty of Kent 1s authorized to implement admin1strat1ve procedures as may be necessary to carry out the provisions of this resolut1on. The City's Fmance Director IS authonzed to cert1fy the amount for the 2014 fiscal year to the appropriate agenc1es Within the State of Washington. SECTION 3. -Severability. If any section, subsection, paragraph, sentence, clause or phrase of this resolution 1s declared unconstitutional or mvalid for any reason, such decision shall not affect the val1d1ty of the rema1n1ng port1ons of th1s resolution. 3 Tax Credit Threshold Panther Lake Annexation SECTION 4. -Savings. Resolution No. 1871 shall remain in full force and effect until the effective date of this resolutron. SECTION 5. -Ratification. Any act consistent with the authority and prror to the effectrve date of thrs resolutron rs hereby ratrfred and affrrmed. SECTION 6. -Corrections by City Clerk or Code Reviser. Upon approval of the Crty Attorney, the City Clerk and the code revrser are authorrzed to make necessary corrections to this resolution, rncludrng the correctron of clerrcal errors; references to other local, state or federal laws, codes, rules, or regulations; or resolutron numberrng and sectron/subsection numberrng. SECTION 7. -Effective Date. This resolution shall take effect and be rn force immedrately upon its passage, however the rmpositron of the sales and use taxes for the 2014 state frscal year authorrzed by this resolutron shall not take effect untrl the commencement of that fiscal year.
