RESOLUTION NO. I&' 51
A RESOLUTION of the city council of the
c1ty of Kent, Washmgton, relatmg to a rev1s1on of
the Downtown Strategic Act1on Plan, and
declanng an emergency for the adopt1on of a
comprehensive plan amendment. CPA-2012-1.
RECITALS
A. Pursuant to the Growth Management Act ("GMA"), the Kent
comprehensive plan provides for subarea plans that are consistent with the
comprehensive plan. RCW 36.70A.080(2).
B. The city council's strategic goal is the creation of neighborhood
urban centers.
C. The city council desires to amend the Downtown Strategic Action
Plan, dated Apnl 19, 2005, to reflect current economic development
opportumt1es.
D. The GMA requires that the city establish procedures governing
amendments to the comprehensive plan that lim1t amendments to once
each year unless certam Circumstances ex1st. RCW 36.70A.130(2). The
c1ty has established a procedure for amendmg the comprehensive plan in
Chapter 12.02 of the Kent City Code (KCC) that perm1ts amendments

in addition to the standard annual update 1f an emergency ex1sts. An
emergency IS defmed as an issue of commumty w1de s1gn1f1cance that
promotes the public health, safety, and general welfare of the c1ty of Kent.
KCC 12.02.010(A).
E. On May 14, 2012, the Economic and Commumty Development
Committee moved to d1rect staff to update the Downtown Strategic Act1on
Plan.
F. The c1ty council fmds that cons1derat1on of proposed amendments to
the comprehensive plan through rev1s1on of the Downtown Strategic Action
Plan IS an 1ssue of commun1ty-w1de s1gnif1cance that promotes the public
health, safety, and general welfare of the c1ty of Kent.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES
HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. -Recitals. The foregomg recitals are mcorporated by
th1s reference.
SECTION 2. -Emerqencv. The revision of the Downtown Strategic
Act1on Plan, dated Apnl 19, 2005, constitutes an 1ssue of community-wide
significance that promotes the public health, safety, and general welfare 1n
accordance w1th the defm1t1on of an emergency as set forth m sect1on
12.02.010(A) of the Kent City Code (KCC). The c1ty council, therefore,
declares that an emergency ex1sts and authorizes staff and the Land Use
and Plann1ng Board to process th1s amendment to the comprehensive plan
outs1de the annual amendment process m KCC 12.02.030.

5ECTION 3. -Severabtlttv. If any sect1on, subsection, paragraph,
sentence, clause or phrase of th1s resolution 1s declared unconst1tut1onal or
mval1d for any reason, such dec1s1on shall not affect the validity of the
remainmg port1ons of th1s resolution.
SECTION 4. -Effecttve Date. Th1s resolution shall take effect and
be m force 1mmed1ately upon 1ts passage.
