A RESOLUTION of the City Council of the City
of Kent, Washington, declaring property purchased for
utility purposes surplus and authorizing its sale to the
highest bidder.
WHEREAS, the City purchased real property located at 12525 Southeast
248th Street, Kent, Washington, as part of the East Hill Public Works Maintenance
Complex; and
WHEREAS, a house is located on that site that is now surplus to the needs
of the City; and the City Council has authority to dispose of surplus property under
Sections 35A.11.010 and 35.94.040 Revised Code of Washington; and
WHEREAS, a public hearing was held on June 5, 2001, at 7:00p.m. in the
City Council Chambers of the Kent City Hall regarding selling the house located at
12525 Southeast 248th Street, Kent, Washington; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The foregoing recitals are incorporated and fully made a part
of this resolution

SECTION 2. Surplus. The house located at 12525 Southeast 248th Street
is surplus to the City's needs and is not required for providing continued public utility
service.
SECTION 3. Disposal. The surplus property shall be disposed of in the
following manner:
A. The property will be sold in a commercially reasonable manner by public auction,
private sale, sealed bid, or any other appropriate method as determined by the Director of
Parks, Recreation and Community Services; or
B. If the surplus property cannot be sold, it may be torn down so that it does not
interfere with the development of the East Hill Public Works Maintenance Complex
SECTION 4. Consideration. The consideration to be paid for the surplus
property shall be the highest amount that is offered in United States dollars.
SECTION 5. Severability. If any section, subsection, paragraph,
sentence, clause, or phrase of this resolution is declared unconstitutional or invalid for any
reason, such decision shall not affect the validity of the remaining portions of this
resolution.
SECTION 6. Effective Date. This resolution shall take effect and be in
force immediately upon its passage.
PASS ED at a regular open public meeting by the City Council of the City of
