A RESOLUTION of the city council of the city of Kent, Washington, amendmg resolution No. 1851 to clanfy the assessment of busmess license fees and application of technology fees to those licensees, as well as to international f1re code rev1ew fees. RECITALS A. On December 13, 2011, the City of Kent City Council passed 1ts Resolution No. 1851, establ1sh1ng, amending, and adJUSting vanous development fees. B. Since enactmg Resolution No. 1851, it has come to the City's attention that clarif1cat1on IS needed regardmg (1) the appl1cat1on of certam busmess l1cense fees to mult1-fam1ly dwellmgs and to out-of-c1ty busmesses, (2) the technology fee amount to be changed for each bus1ness l1cense transaction, and (3) the appl1cat1on of technology fees to certam f1re code rev1ew fees. 1 Resolution Amend Resolution 1851 j ' J l l ' j NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: RESOLUTION SECTION 1. Repealer. The follow1ng Resolutions are hereby repealed 1n the1r entirety: Resolution No. 1311, relating to Business License Code to the Hearing Exammer is hereby repealed 1n 1ts entirety; Resolution No. 1524, relating to a fee schedule for planning and land use appl1cat1ons 1s hereby repealed m 1ts entirety; Resolut1on No. 1594, relatmg to a fee schedule for plann1ng and land use appl1cat1ons IS hereby repealed 1n 1ts ent1rety; Resolution No. 1676, relat1ng to the Fee schedule under the International Bulldmg, Res1dent1al, Mechanical and F1re codes and the Un1form Plumbmg Code IS hereby repealed 1n 1ts entirety; Resolution No. 1686, relating to the fee schedule and fee schedule notes for planning and land use applications IS hereby repealed in 1ts entirety; Resolution No. 1740, relating to the fees for business licenses, plannmg and land use appl1cat1ons, and perm1ts and inspections under the proviSIOns of the International Bu1ldmg, Residential, Mechamcal, and F1re Codes and the Un1form Plumbmg Code IS hereby repealed 1n 1ts ent1rety; Resolution No. 1828, relating to fees concerning the deferral of certain development m1tigat1on fees 1s hereby repealed m its ent1rety; 2 Resolution Amend Resolution 1851 Resolution No. 1831, relatmg to development mitigation fees to which the fee deferral lien applies is hereby repealed 1n 1ts ent1rety. SECTION 2. Adopt. Business License Fees. Begmmng January 1, 2012, m accordance with chapter 5.01 of the Kent City Code, annual fees for bus1ness l1censes will be based on the number of full and part-time employees employed at each busmess, but for mult1-fam1ly apartment and condom1n1um businesses, the fee w1ll be based on number of dwellmg units. The fees shall be assessed as follows: A. Number of Employees of Fee Business 0-24 $100 25-49 $200 50-99 $400 100 or more $600 B. Number of Multi-Family Dwelling Units Fee 2 -10 Un1ts $100 11-50 Umts $300 51 Un1ts and above $600 C. The Home occupation busmess l1cense fee IS $50.00. D. Contractors doing busmess in Kent whose physical location 1s outside the city of Kent shall be assessed a $100 fee. SECTION 3. -New Fee Schedule -Hearing Examiner Fees. As authonzed by KCC Sect1on 2.32.155, the fee that an applicant shall pay for 3 Resolution Amend Resolution 1851 any permit or approval that requires either an open or a closed record public hearing before the city's hearing exam1ner and the fee for any appeal of any deciSion or recommendation to the hearing examiner shall be 1n the amounts shown on Exhibits B through F. 5ECTION 4. -New Fee Schedule -Permit Technology Fee. As authorized by KCC Sect1on 3.11.010(c), begmnmg January 1, 2012, a technology fee for all busmess license transactions w1ll be assessed 1n the amount of one dollar ($1) per transaction; every other fee established by th1s resolution w1ll be assessed a technology fee 1n an amount equal to three percent (3%) of the fee or ten dollars ($10.00), whichever IS greater, w1th the exception of the exclus1ons l1sted in Exhibit A. SECTION 5. -International F1re Code Fees Established. As authonzed by KCC Section 13.01.120, the fee schedule attached as Exhibit B shall govern the monetary charges assessed by the c1ty for rev1ewmg and processmg perm1t applications, for issuing perm1ts and other approvals, and for all related mspections. SECTION 6. -InternatiOnal Buildmg Code and International Residential Code -Building permit and plan review fees. Pursuant to Section 14.01.090 of the Kent City Code, the fees to be assessed for building perm1ts and related inspections under the International Building Code or the International Residential Code shall be as set forth m Exhibit C wh1ch IS attached and Incorporated into this Resolution, w1th the followmg modifications: 1. Standard plan review Fees. Whenever construction documents, as defmed in the International Building Code and InternatiOnal Residential Code, are submitted for rev1ew pursuant to section 107 of the InternatiOnal Buildmg Code or sect1on R106 of the InternatiOnal Residential 4 Resolution Amend Resolution 1851 Code, a plan rev1ew fee equal to sixty-five (65) percent of the buildmg perm1t fee shall be assessed. 2. Basic plan review fees. The basic plan review fee, after and in addition to the payment of the mit1al standard plan rev1ew fee set forth m subsection (1) above, shall be a fee of seventy-s1x ($76.00),for each permit 1ssued upon a cert1f1ed basic plan. Add1t1onal plan rev1ew fees shall also be assessed at a rate of one hundred two dollars ($102.00) per hour, or a port1on thereof for an add1t1onal plan review requ1red for changes, additions, or rev1sions to plans. 3. Administration of basic plans. Basic plans shall be administered as follows: a. "Basic plans" are defined as complete plans for an entire detached single fam1ly restdenttal buildmg, approved as such by the butldmg offtctal, whtch: (i) Are clearly marked as being approved and certified as "bas1c" by the buildmg off1c1al; (ii) Bear the author's (including, but not limited to, architect, engineer, or others) acknowledgment and approval of the plans submitted for use in the construction of a number of buildmgs, without any limitation of quant1ty or locat1on. If any portion 1s designed by a licensed architect or engmeer, this acknowledgment shall bear the author's stamp and stgnature. (111) Basic plan rev1ew fees shall apply only to detached single famtly res1dent1al buildings and shall apply only to the onginattng owner or applicant. 5 Resolution Amend Resolution 1851 (iv) Changes to basic plans wh1ch alter the extenor dimensions or structure of the building shall be treated as a new perm1t appl1cat1on. b. The process for admm1stenng bas1c plans shall be as follows: (i) Any person may apply for plan rev1ew and certification of a basic plan by f1l1ng an application for such plan review and cert1f1cat1on, along w1th two (2) or more complete sets of plans and the standard plan rev1ew fee. (ii) Upon completion and approval of plan review, the applicant shall prov1de reproducible cop1es of complete, approved plans to the bulldmg off1c1al. c. The c1ty's building official is authorized and empowered to interpret and determme the applicability and admm1strat1on of the provisions of th1s Resolution. SECTION 7. -International Mechanical Code -Mechanical permit and plan review fees. Pursuant to Sect1on 14.01.090 of the Kent City Code, the fees to be assessed for mechanical perm1ts 1ssued for the Installation of mechanical equ1pment under the Internattonal Mechanical Code or the Internattanal Restdential Code, as may be applicable, shall be as set forth in Exhibit D, wh1ch IS attached and mcorporated mto th1s ordmance, With the followmg mod1f1cat1ons: 1. Standard plan review fees. Whenever construction documents, as defmed m the Internattonal Mechantcal Code or the International Restdenttal Code, are submitted for rev1ew pursuant to sect1on 106 of the International Mechantcal Code or section R106 of the 6 Resolution Amend Resolution 1851 j ! International Residential Code, a plan rev1ew fee equal to twenty-five (25) percent of the mechamcal permit fee shall be assessed. SECTION 8. -Umform Plumbing Code -Plumbing permit and plan review fees. Pursuant to Section 14.01.090 of the Kent City Code, the fees to be assessed for plumbmg perm1ts 1ssued for the mstallat1on of plumbing equipment under the Uniform Plumbing Code or the International Residenttal Code, as may be applicable, shall be as set for in Exhibit E, wh1ch IS attached and incorporated mto this Resolution, with the followmg modifications: 1. Whenever construction documents, plans, specifications, engineenng calculations, diagrams or other data are submitted for rev1ew pursuant to section 103 of the Umform Plumbmg Code or section R106 of the International Residential Code, a plan rev1ew fee equal to twenty-f1ve (25) percent of the plumbmg permit fee shall be assessed. SECTION 9. -Construction, Land Use and Development Fees. Pursuant to chapters 6.03, 6.06, 6.07, 7.02, 7.04, 11.06, 12.01, and other authorizations elsewhere 1n the Kent City Code, the appl1cat1ons, permits, approvals, rev1ew, mspect1on and other fees for various construction, land use and development act1ons shall be as shown in the attached Exhibit F. SECTION 10. Annual Consumer Price Index CCP!) Adjustment. On the first day of each calendar year, all fees, rates and charges established m this resolution w1ll adJust by the Consumer Pnce Index (CPI), specifically the CPI-W Seattle-Tacoma-Bremerton, measured from June 1 through June 1, 1f the CPI-W reflects an upward adJustment from the prev1ous annual June to June penod. Fees shall move m mcrements of not less than $.50 and shall be rounded down for amounts from $.01 through $.24 and from $.51 through $.74 and shall be rounded up for amounts from $.25 through 7 Resolution Amend Resolution 1851 $.49 and from $.75 through $.99. If the year to year change in the CPI-W does not result in a change m any fee, rate or charge, that fee, rate, or charge w1ll be subJect to a cumulative calculation by addmg the annual CPI-W annual adJustments s1nce the last effective change and Implementing an adJustment according to the increments established 1n th1s sect1on. This sect1on and 1ts related CPI adJustments will not apply, however, to any Sect1on 4 Permit Technology fees. SECTION 11. -Savings. Resolution Nos. 1311, 1524, 1594, 1676, 1686, 1740, 1828, 1831, and 1851, and the fees established by those resolutions, shall remam m full force and effect until the date the new fees are assessed and collected tn accordance With this resolut1on. SECTION 12. -Severability. If any sect1on, subsection, paragraph, sentence, clause or phrase of th1s resolution is declared unconstitutional or invalid for any reason, such dec1s1on shall not affect the validity of the remammg portions of this resolution. SECTION 13. -Effective Date. This resolution shall take effect and be m force 1mmed1ately upon 1ts passage.
