RESOLUTION NO. _/_P_~_O __
A RESOLUTION of the City Council of the
City of Kent, Washmgton, relatmg to vehicular
speed l1m1ts on certa1n des1gnated streets, as
posted by official traffic control dev1ces, pursuant
to Chapter 9.40 of the Kent City Code.
RECITALS
A. The Kent Traffic Code, Sect1on 9.36.010, adopts by reference
the Model Traffic Ordinance set forth 1n Washmgton Admm1strat1ve Code 1n
Chapter 308-330 WAC (Ordinance 3170).
B. Provisions of the Model Traffic Ordmance, Washington
Administrative Code Sect1on 308-330-270, and RCW 46.61.415, set forth
the procedure for the local authonty to determme and declare the speed
limits on c1ty arterials, streets and other nghts of way, based on an
engmeenng and traffic mvest1gat1on by the traff1c eng1neer.
C. Pursuant to the Model Traffic Ordinance, Chapter 9.40 of the
Kent City Code was adopted to prov1de that the City may establish speed
llm1ts on certam des1gnated streets by resolution.

D. A list of the speed limits on certain designated streets in the
City was properly made and adopted by Resolution No. 1844 following an
engmeering and traffic mvestJgatJon.
E. As a result of an engineering and traffic investigation, the City
Council desires to update and amend the list of speed 11m1ts set forth m
Resolut1on No. 1844.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. -SECTION 1. -Repealer. Resolution No. 1844
relating to vehicular speed limits IS hereby repealed in 1ts entirety.
SECTION 2. -Adopt. Increasing or Decreasing Speed Limits
on Certain Streets, Highways or other Rights-of-Way.
It 1s determined, on the bas1s of engmeenng and traffic
investigations, that the speed permitted by state law upon the followmg
streets or port1on thereof IS less than, or in some cases, more than, IS
reasonable and safe for the operation of vehicles under the conditions
found to ex1st on that street or portion thereof. It IS hereby declared that
the speed limits on such streets shall be as hereinafter set forth on the
streets or port1ons of the streets listed, at all times, unless otherwise
spec1f1ed, after official traffic control devices have been posted to g1ve
not1ce thereof; provided, that 1n no case shall the speed l1m1t on City
streets be lower than twenty (20) m1les per hour or exceed s1xty (60) m1les
per hour.

SECTION 3. -Dut1es of citY traffic engmeer. The city traffic
engmeer shall take whatever steps are necessary to comply w1th all
statutory d1rect1ves regardmg approval of these speed l1m1ts by the Stater
where applicable; post1ng of official traffic control dev1ces; and the
regulation of tim1ng of traffic signalsr as set forth in the Model Traffic
Ord1nancer adopted by reference pursuant to Sect1on 9.36.010 of the Kent
City Coder and more spec1f1cally 1 Sect1on 308-330-270 of the Washmgton
Admmistrat1ve Coder RCW 46.61.415 1 and all other applicable sect1ons of
the Model Traffic Ordmance.
SECTION 4. -SeverabilitY. If any section 1 subsection 1 paragraph 1
sentence, clause or phrase of th1s resolution IS declared unconstitutional or
mvaild for any reason, such dec1s1on shall not affect the validity of the
remaining port1ons of th1s resolution.

SECTION 5. -Ratification. Any act consistent with the authority
and pnor to the effect1ve date of th1s resolution is hereby ratified and
affirmed.
SECTION 6. -Corrections bv City Clerk or Code Reviser. Upon
approval of the City Attorney, the City Clerk and the code reviser are
authonzed to make necessary corrections to this resolution, including the
correction of clencal errors; references to other local, state or federal laws,
codes, rules, or regulations; or resolution numbenng and
section/subsection numbenng.
SECTION 7. -EffectiVe Date. Th1s resolution shall take effect and
be in force when approved by the Washmgton Secretary of Transportation.
