RESOLUTION NO. / fij'f
A RESOLUTION of the City Council of the City of
Kent, Washington, relatmg to vehicular speed limits on
certam designated streets, as posted by off1c1al traffic
control dev1ces, pursuant to Chapter 9.40 of the Kent City
Code.
RECUALS
A. The Kent Traffic Code, Section 9.36.010, adopts by reference the
Model Traffic Ordmance set forth in Washmgton Administrative Code in Chapter
308-330 WAC (Ordinance 3170).
B. Provisions of the Model Traffic Ordinance, Washington Admmistrat1ve
Code Section 308-330-270, and RCW 46.61.415, set forth the procedure for the
local authonty to determme and declare the speed l1m1ts on City arterials, streets
and other nghts of way, based on an engineenng and traff1c mvestigation by the
traffic engmeer.
C. Pursuant to the Model Traffic Ordmance, Chapter 9.40 of the Kent City
Code was adopted to provide that the City may establish speed l1m1ts on certain
designated streets by resolution.
D. A list of the speed limits on certam designated streets m the City was
properly made and adopted by Resolution No. 1842 follow1ng an eng1neenng and
traffic investigation.

F. As a result of an engineering and traffic investigation, the City Council
desires to update and amend the l1st of speed limits set forth m Resolution No.
1842.
G. Resolution No. 1842 contained errors that must now be corrected.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. -Repealer. Resolution No. 1842 relating to vehicular speed
limits IS hereby repealed in 1ts entirety.
SECTION 2. -Adopt. Increasing or Decreasing Speed Limits on
Certain Streets, Highways or other Rights-of-Way.
It is determmed, on the bas1s of engmeenng and traff1c mvest1gat1ons, that
the speed permitted by state law upon the followmg streets or port1on thereof IS
less than, or m some cases, more than, is reasonable and safe for the operation of
vehicles under the conditions found to ex1st on that street or portion thereof. It is
hereby declared that the speed l1mits on such streets shall be as hereinafter set
forth on the streets or port1ons of the streets listed, at all t1mes, unless otherwise
specified, after off1c1al traffic control devices have been posted to g1ve not1ce
thereof; prov1ded, that m no case shall the speed llm1t on City streets be lower than
twenty (20) miles per hour or exceed s1xty (60) miles per hour.

SECTION 3. -Duties of city traffiC engineer. The city traffic engineer shall
take whatever steps are necessary to comply wtth all statutory d1rect1ves regardmg
approval of these speed limtts by the State, where applicable; posttng of off1c1al
traffic control devtces; and the regulatton of t1mmg of trafftc stgnals, as set forth m
the Model Traff1c Ordmance, adopted by reference pursuant to Sectton 9.36.010 of
the Kent City Code, and more spectftcally, Sectton 308-330-270 of the Washmgton
Admin1strat1ve Code, RCW 46.61.415, and all other applicable sections of the Model
Traffic Ordinance.
SECTION 4. -SeverabilitY. If any section, subsection, paragraph, sentence,
clause or phrase of th1s resolutton is declared unconstitutiOnal or mvalid for any
reason, such decision shall not affect the val1d1ty of the rematnmg port1ons of th1s
resolution.
SECTION 5. -Ratification. Any act consistent with the authority and prior
to the effective date of th1s resolution IS hereby rat1f1ed and afftrmed.

SECTION 6. -Corrections by City Clerk or Code Rev1ser. Upon approval of
the City Attorney, the City Clerk and the code rev1ser are authonzed to make
necessary corrections to th1s resolution, mcludmg the correction of clerical errors;
references to other local, state or federal laws, codes, rules, or regulations; or
resolution numbenng and sect1onjsubsect1on numbenng.
SECTION 7. -Effective Date. This resolution shall take effect and be in
force when approved by the Washmgton Secretary of Transportation.
