A RESOLUTION of the City Council of the City of
Kent, Washmgton, relatmg to vehicular speed limits on
certain des1gnated streets, as posted by official traffic
control dev1ces, pursuant to Chapter 9.40 of the Kent City
Code.
RECITALS
A. The Kent Traffic Code, Section 9.36.010, adopts by reference the
Model Traffic Ordmance set forth 1n Washmgton Administrative Code m Chapter
308-330 WAC (Ordinance 3170).
B. Provisions of the Model Traffic Ordinance, Washington Admmistrat1ve
Code Section 308-330-270, and RCW 46.61.415, set forth the procedure for the
local authonty to determme and declare the speed l1m1ts on c1ty artenals, streets
and other nghts of way, based on an engineering and traffic mvestigat1on by the
traffic engmeer.
C. Pursuant to the Model Traffic Ordinance, Chapter 9 40 of the Kent City
Code was adopted to prov1de that the City may establish speed lim1ts on certam
designated streets by resolution.
D. A list of the speed limits on certam des1gnated streets in the City was
properly made and adopted by Resolution No. 1750 followmg an eng1neenng and
traffic mvest1gat1on.

E. As a result of an engineering and traffic investigation, the City Council
desires to update and amend the list of speed lim1ts set forth in Resolution No.
1750.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. -Repealer. Resolution No. 1750 relating to vehicular speed
limits IS hereby repealed m 1ts entirety.
SECTION 2. -Adopt. Increasing or Decreasing Speed Limits on
Certain Streets, Highways or other Rights-of-Way.
It IS determ1ned, on the bas1s of engmeering and traffic invest1gat1ons, that
the speed perm1tted by state law upon the follow1ng streets or port1on thereof IS
less than, or in some cases, more than, is reasonable and safe for the operat1on of
vehicles under the cond1t1ons found to ex1st on that street or portion thereof. It IS
hereby declared that the speed l1m1ts on such streets shall be as hereinafter set
forth on the streets or port1ons of samethe streets l1sted, at all times, unless
otherw1se specified, after official traffic control devices have been posted to g1ve
not1ce thereof; prov1ded, that in no case shall the speed l1m1t on City streets be
lower than twenty (20) miles per hour or exceed sixty (60) miles per hour.

SECTION 3. -Duttes of ctty trafftc engmeer. The c1ty traffic engineer shall
take whatever steps are necessary to comply w1th all statutory direct1ves regarding
approval of these speed l1m1ts by the State, where applicable; postmg of official
traffic control devices; and the regulation of t1mmg of traff1c s1gnals, as set forth in
the Model Traff1c Ordmance, adopted by reference pursuant to Section 9.36.010 of
the Kent City Code, and more speCifically, Section 308-330-270 of the Washington
Adm1n1strat1ve Coder RCW 46.61.415, and all other applicable sect1ons of the Model
Traffic Ordinance.
SECTION 4. -Severabtlitv. If any section, subsect1onr paragraph, sentence/
clause or phrase of th1s resolut1on IS declared unconst1tut1onal or invalid for any
reason/ such decision shall not affect the vahd1ty of the remaining portions of th1s
resolution.
SECTION 5. -Ratiftcation. Any act consistent with the authority and prior
to the effective date of this resolution 1s hereby rat1fied and affirmed.
SECTION 6. -Corrections bv Citv Clerk or Code Reviser. Upon approval of
the City Attorney, the City Clerk and the code rev1ser are authonzed to make
necessary corrections to th1s resolution, including the correction of clencal errors;
references to other local, state or federal laws, codes, rules, or regulations; or
resolut1on numbering and sect1onjsubsect1on numbenng.
SECTION 7. -Effecttve Date. Th1s resolution shall take effect and be in
force immediately upon 1ts passage.
