A RESOLUTION of the City Council of the
City of Kent, Wash1ngton, authonz1ng appl1cat1ons
to the Recreat1on and Conservation Off1ce (RCO)
for state fundmg assistance for a Washmgton
Wildl1fe and Recreation Program ("WWRP") as
prov1ded in Chapter 79A.l5 RCW, Acqu1s1t1on of
Hab1tat Conservation and Outdoor Recreat1on
Lands.
RECITALS
A. The City of Kent has approved a comprehensive plan that
includes development 1n the West Hill Park and Lake Mend1an Park areas,
and acqu1S1t1ons m the Clark Lake Park area and properties w1th1n the
newly annexed Panther Lake area.
B. Under the prov1s1ons of the WWRP, state funding ass1stance
has been requested to a1d m f1nancmg the development in the West H1ll
Park and Lake Mend1an Park areas, and acqu1s1t1ons m the Clark Lake Park
area and properties w1thm the newly annexed Panther Lake area.
C. The City of Kent considers 1t m the best public Interest to
complete the development in the West Hill Park and Lake Mend1an Park
areas, and acqu1s1t1ons m the Clark Lake area and propert1es w1thin the
newly annexed Panther Lake area.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. -Aopl1cat10n. The c1ty's Parks, Recreation, and
Commun1ty Serv1ces director IS authonzed to make formal appl1cat1on to
RCO for fundmg assistance.
SECTION 2. -Use of Funds. Any fund1ng ass1stance rece1ved will be
used for the 1mplementat1on of the proJect referenced above, which IS the
development 1n the West Hill Park and Lake Mend1an Park areas, and
acquiSitions in the Clark Lake Park area and propert1es Within the newly
annexed Panther Lake area.
SECTION 3. -Non-Cash Commitments. The City of Kent
acknowledges that 1t 1s responsible for supporting all non-cash
commitments to the sponsor share should they not materialize.
SECTION 4. -Use Retained in Perpetuitv. The City of Kent
acknowledges that any property acquired or fac1l1ty developed w1th
Recreat1on and Conservation Fundmg Board (RCFB) fmanc1al a1d must be
placed 1n use for the funded purpose as an outdoor recreation facil1ty and
be reta1ned 1n such use 1n perpetuity unless otherw1se prov1ded and agreed
to by the City of Kent and RCFB.
SECTION 5. -Resolution -Part of Application. This resolution may
become part of a formal appl1cat1on to RCO.
SECTION 6. -Public Comment. The City of Kent provided
appropnate opportun1ty for publ1c comment heard on May 13, 2010.

SECTION 7. -Severabtfity. If any sect1on, subsection, paragraph,
sentence, clause or phrase of th1s resolution IS declared unconst1tut1onal or
invalid for any reason, such dec1sion shall not affect the validity of the
rema1n1ng portions of th1s resolution.
SECTION 8. -Ratification. Any act consistent with the authority
and pnor to the effect1ve date of th1s resolution IS hereby rat1f1ed and
affirmed.
SECTION 9. -Corrections by City Clerk or Code Rev1ser. Upon
approval of the City Attorney, the City Clerk and the code rev1ser are
authonzed to make necessary corrections to th1s resolution, 1nclud1ng the
correction of clencal errors; references to other local, state or federal laws,
codes, rules, or regulations; or resolution numbenng and
sect1on/subsect1on numbenng.
SECTION 10. -Effective Date. This resolution shall take effect and
be in force 1mmed1ately upon 1ts passage.
