Regional Fire Authority RESOLUTION NO. f V J.._{ A RESOLUTION of the City Council of the City of Kent, Washmgton, expressmg 1ts support for Ballot Proposition No. 1: "Kent F1re Department Reg1onal F1re Authority Plan," to be put before voters at the April 27, 2010 special elect1on. RECITALS A. In accordance with Ch. 52.26 of the Rev1sed Code of Washmgton ("RCW"), the City of Kent and King County Fire Protection D1stnct No. 37 are seekmg voter authonzation for the format1on of the Kent Fire Department Regional Fire Authonty and approval of the Reg1onal Fire Authonty Plan. The ability to respond to emergency Situations by f1re protect1on and emergency med1cal service agenc1es has not kept up or progressed with commun1ty needs and serv1ce demands. Providing an effect1ve fire protection and emergency med1cal serv1ce system to respond to these needs requires a collaborative partnership among local and regional governments and the pnvate sector. There are effic1enc1es that can be gamed by reg1onal f1re protection and emergency med1cal service delivery, while st1ll maintammg local control. Timely development of sigmficant projects can best be ach1eved by usmg existmg taxmg authority to address fire protection and emergency serv1ce needs, with new benefit chargmg authonty to address cnt1cal f1re protect1on proJects and emergency serv1ces. 1 Support for Ballot Proposition No. 1- Kent Fire Dept. Regional Fire Authority B. Smce 1973, the City of Kent F1re Department ("the City") and King County Fire Protection District No. 37 ("the D1stnct") have had a cooperative partnership, stnvmg to provide the highest level of f1re and emergency medical services to their citizens withm the conf1nes of available resources. The City and the District would l1ke to expand this cooperative partnership by creating a new entity to provide regional fire protection services to the Citizens withm their respective boundanes. Toward th1s end, on January 19, 2010, the Kent City Council and the Commissioners of the D1stnct adopted a resolut1on, which provided for the subm1ss1on to qualified electors of the City and the Distnct, at a special elect1on to be held on April 27, 2010, of a proposition that, pursuant to Ch. 52.26 RCW, would approve a plan to form a Reg1onal F1re Protection Serv1ce Authority w1thm the boundanes of the City and the Distnct, effective July 1, 2010, to be funded by a property tax levy and a new six-year benefit charge. C. RCW 42.17.130 allows the City to take a position on a ballot proposal if act1on 1s taken at an open meeting, the not1ce of which includes the title and number of the ballot propos1t1on, and if members of the public and members of the legislative body mvolved are afforded approximately equal opportunity for the expressiOn of an opposmg v1ew. On the night Council considered adopt1on of this resolut1on, it held an open publ1c meeting, after having g1ven proper not1ce, to hear from both proponents and opponents of the Kent F1re Department Regional Fire Authonty. Having considered all statements for and agamst the formation of the Kent Fire Department Regional Fire Authonty and adoption of its Regional Fire Authority Plan, the Council adopts th1s resolution expressmg 1ts support for Propos1t1on No. 1. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: 2 Support for Ballot Proposition No. 1- Kent Fire Dept. Regional Fire Authority SECTION 1. -Recitals Adopted as Findings. The Kent City Council adopts the foregoing recitals as 1ts findings as if each were set forth herein. SECTION 2. -City Suooort for Ballot Prooositton No. 1. The Kent City Counc1l hereby expresses its support for the formation of the Reg1onal Fire Authonty and the adopt1on of the Reg1onal F1re Authority Plan that will appear on the Apnl 27, 2010, special election ballot. SECTION 3. -Severability. If any sect1on, subsection, paragraph, sentence, clause or phrase of this resolution is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of th1s resolution. SECTION 4. -Rattfication. Any act cons1stent w1th the authonty and prior to the effective date of th1s resolution is hereby ratified and affirmed. SECTION 5. -Corrections by City Clerk or Code Reviser. Upon approval of the City Attorney, the City Clerk and the code rev1ser are authonzed to make necessary corrections to this resolution, including the correct1on of clencal errors; references to other local, state or federal laws, codes, rules, or regulations; sect1onjsubsection numbering. Th1s resolution shall take effect and be in force immediately upon 1ts passage.
