HomeMy WebLinkAbout1783Resolution No. 1783 (Amending or Repealing Resolutions) CFN = 206 -Street Comprehensive Plan Passed -3/18/2008 Transportation Element Amendment-Emergency RESOLUTION NO. /JY,E A RESOLUTION of the City Council of the City of Kent, Washmgton, relating to comprehensive planning; continumg ongomg efforts to update the City's Transportation Master Plan; amendtng the transportation element of the City's comprehensive plan related to the adoptton of a Transportation Master Plan; and, declanng an emergency for the adoption of the comprehensive plan amendment. RECITALS A. The City of Kent Transportation Master Plan (TMP), when integrated mto the City's comprehensive plan, wtll serve as the City's bluepnnt for long range transportation plannmg. The transportation element of the City's comprehensive plan provtdes the foundatton, gutdance, and a ltst of capital improvements for the transportation system wtthin the City. B. The City's TMP process began in the fall 2005 with the City Counctl's approval of a contract for consultant servtces. The City has worked wtth a Citizen's task force to address development of the TMP. The City Council's ftrst workshop was conducted on June 20, 2006, after prior public outreach. Subsequent council workshops and committee meetmgs were conducted on July 5 and 10, 2006; August 21, 2006; September 5, 2006; February 27, 2007; and December 3, 2007. These meetmgs provided an opportunity for explanation of the plannmg process and to keep the City Counctl up to date on the development of the TMP. In add1t1on, the City 1 Transportation Element Amendment -Emergency engaged in an extensive stakeholder involvement process to promote and provide a variety of meaningful forums for communication with the City regard1ng the draft TMP. See Stakeholder Involvement Report (CH2MHill, December 2007). C. An amendment to the City's comprehensive plan, transportation element, will be cons1dered in the process for adopt1on of the TMP. Transportation has been an ongoing prionty for the City. Through its comm1ttee meet1ngs and workshops, the Council has been studymg transportation 1ssues such as concurrency, performance standards, transit planning, level of serv1ce standards, TMP fundmg opt1ons, TMP proJect pnont1es, and transportation Impact fees. As a culmination of this analys1s, the Council will be addressmg the adopt1on of a TMP and amendments to the comprehensive plan transportation element to mtegrate the TMP into the comprehensive plan. D. The Growth Management Act ("GMA") requ1res the City to establish procedures governmg amendments to the comprehensive plan that limit amendments to once each year unless certain Circumstances ex1st. RCW 36. 70A.130(2). The City has established a procedure for amending the comprehensive plan in Chapter 12.02 Kent City Code (KCC). Here, the City Counc1l has effectively mamtained on 1ts Docket the TMP and comprehensive plan amendment. Further, the KCC perm1ts amendments, 1n addition to the standard annual update, 1f an emergency ex1sts. An emergency IS defmed as an 1ssue of community Wide s1gn1ficance that promotes the public health, safety, and general welfare of the City of Kent. KCC 12.02.010(A). E. The City Council finds that consideration of proposed amendments to the comprehensive plan transportation element have been pend1ng for over eighteen months and are 1ssues of community-wide s1gn1f1cance that promote 2 Transportation Element Amendment -Emergency the public health, safety, and general welfare of the City of Kent; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: RESOLUTION SECTION 1. -Recitals. The foregoing recitals are incorporated by this reference. SECTION 2. -Process and Direction. The City shall proceed w1th cons1derat1on of the TMP and comprehensive plan amendment Without undue delay. Such consideration shall include compliance with the State Environmental Policy Act; Land Use and Plannmg Board workshop, public hearing, and recommendation; Council comm1ttee recommendation, and fmal action by the City Council. SECTION 3. -Emergency. Pursuing revisions of the comprehensive plan to prov1de for amendments to the transportation element related to adoption of a Transportation Master Plan is an issue of community-wide significance that promotes the public health, safety, and general welfare m accordance w1th the def1n1t1on of an emergency as set forth m section 12.02.010(A) of the Kent City Code (KCC). The City Council, therefore, declares that an emergency ex1sts and authonzes staff to process this rev1s1on to the comprehensive plan outside the annual amendment process in KCC 12.02.030. 3 Transportation Element Amendment -Emergency SECTION 4. -Severability. If any section, subsection, paragraph, sentence, clause or phrase of th1s resolution is declared unconstitutional or invalid for any reason, such dec1s1on shall not affect the validity of the remainmg portions of this resolution. SECTION 5. -Ratification. Any act consistent with the authority and prior to the effective date of th1s resolut1on is hereby rat1f1ed and affirmed. SECTION 6. -Effecttve Date. This resolution shall take effect and be in force Immediately upon its passage. PASSED at a regular meeting of the City Council of the City of Kent, Washmgton th1s /f> day of March, 2008.
