IV 1 A RESOLUTION of the City council of the City of Kent, Washmgton, determ1nmg that certam public utility equipment 1s surplus to the c1ty's needs, prov1d1ng for the sale thereof, statmg the cons1derat1on to be pa1d for the equipment, and author1z1ng the director of public works to enter 1nto a sales agreement w1th the highest bidder. RECITALS A. The City of Kent ("City") has 1n 1ts possess1on certam equ1pment, described 1n exh1b1t A attached and mcorporated by th1s reference, wh1ch IS no longer actively 1n use as part of the City's public ut1l1ty system. B. The director of public works has determined that the City no longer has any use or need for that equ1pment. C. The City Council held a public heanng on Tuesday, October 17, 2006 at a regularly scheduled c1ty council meet1ng and 1nv1ted comments regardmg the City's mtent1on to surplus the equipment. D. RCW 35.94.040 requ1res that the City determme, after a public hear1ng and by resolut1on of the c1ty council that equipment or~g1nally acqu1red for publiC utility purposes IS surplus to the City's needs and should be leased, sold or conveyed. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: RESOLUTION SECTION 1. -ReCitals Incorporated. The forego1ng rec1tals are mcorporated and fully made a part of th1s resolution. 1 Surplus Property - Water System Utility Equipment SECTION 2. -Eqwpment Deemed Surplus. The ut1l1ty equ1pment descnbed m the attached and mcorporated Exh1b1t A, wh1ch was ong1nally acqu1red for publiC ut1l1ty purposes, IS now surplus to the City's needs and IS not required for prov1dmg contmued public ut1l1ty serv1ce. SECTION 3. -Public's Best Interest. It IS m the public's best mterest that th1s surplus equ1pment shall be sold by b1d to the highest bidder. In the event the equ1pment 1s not sold at the auct1on, 1t Will be sold for scrap metal. SECTION 4. -ConsideratiOn to be Pa1d. The cons1derat1on to be pa1d for the surplus property shall be 1n U.S. dollars m the form of cash or cashier's check. SECTION 5. -Authonty of Public Works Director. The Director of Public Works JS authonzed to enter mto an agreement w1th the highest bidder to effect the sale of the surplus property. SECTION 6. -Effect1ve Date. Th1s resolution shall take effect and be 1n force 1mmed1ately upon Jts passage. PASSED at a regular open public meetmg by the City Council of the City of Kent, Washmgton, th1s _LJ_ day of October, 2006.
