A RESOLUTION of the City council of the City of
Kent, Washmgton, repealmg Resolution No. 1698, wh1ch
established a Hab1tat ProtectiOn and Restoration Plan.
RECITALS
A. On Apnl 19, 2005, the c1ty counc1l adopted Resolut1on No. 1698
wh1ch established a Hab1tat Protect1on and Restoration Plan. This plan was
established m support of the c1ty's Cnt1cal Areas Ordmance, also adopted on Apnl
19, 2005.
B. The state Departments of Ecology and Commun1ty, Trade, and
Economic Development appealed the c1ty's adopt1on of the Cnt1cal Areas Ordmance
to the Growth Management Heanngs Board. In response to that appeal, the
Growth Management Heanngs Board 1ssued a Fmal DecJsJon and Order that
declared the c1ty's Cnt1cal Areas Ordmance did not comply w1th certam aspects of
the Growth Management Act, Chapter 36.70A RCW.
C. In response to the Growth Management Heanngs Board's Final
DecJsJon and Order, the c1ty council adopted a rev1sed Cnt1cal Areas Ordmance on
August 15, 2006, m order to demonstrate compliance w1th the GMA as required by
the Board.
D. Based m large part on the foregomg events, the City Counc1l has
determmed that 1mplementat1on of th1s plan IS no longer necessary.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. -Repealer. The Habitat Protection and Restoration Plan
adopted by Resolution No. 1698 IS no longer necessary. Accordmgly, the c1ty
counc1l repeals Resolution No. 1698 1n 1ts ent1rety.
SECTION 2. -Severability. If any sect1on, subsection, paragraph,
sentence, clause or phrase of th1s resolution 1s declared unconst1tut1onal or mval1d
for any reason, such deciSIOn shall not affect the validity of the remam1ng port1ons
of th1s resolution.
SECTION 3. -Rattflcat!On. Any act cons1stent w1th the authonty and pnor
to the effect1ve date of th1s resolut1on 1s hereby rat1fied and aff1rmed.
SECTION 4. -Effecttve Date. Th1s resolut1on shall take effect and be 1n
force 1mmed1ately upon 1ts passage.
PASSED at a regular 39en public meet1ng by the City council of the c1ty of
Kent, Washmgton, th1s /S day of August, 2006.
CONCURRED 1n by the mayor of the c1ty of Kent this /6 day of August,
2006.
