HomeMy WebLinkAbout1698Resolution No. 1698 CFN-961 -Growth Management Plan Passed -4/19/2005 Hab1tat Protection and Restoration Plan Repealed by Resolution No. 1730 RESOLUTION NO. //p 9 g' A RESOLUTION of the City Council of the City of Kent, Washington, authorizing a critical areas Habitat Protection and Restoration Plan in support of the City's adoption of a critical areas ordinance, all in compliance with the Growth Management Act. RECITALS A. Per RCW 36.70A.l30(4), the Growth Management Act (the "GMA") requires the City of Kent to review and revise its Comprehensive Plan and development regulations to ensure that the Comprehensive plan and the development regulations are in compliance with the requirements of the GMA. To this end, the City Council adopted an updated Comprehensive Plan on July 20, 2004, and a revised Critical Areas Ordinance (the ''CAO") on Aprill9, 2005. B. One element of the protections the City desires to provide to critical areas is a Habitat Protection and Restoration Plan (the "Habitat Plan"). The Habitat ...,._ Plan will be put in place to enhance cntical area habitat and to offset any unintended ~ past and present risk of degradation to existing wetland functions and values. Streams will also be included in the Habitat Plan sine~ wildlife that utilize wetlands also utilize streams and their associated buffers. The Habitat Plan will use a "landscape approach" to understand the relationship between stormwater runoff, wetland functions, and fish 1 Habitat Protection and Restoration Plan and wildlife habitat. The Habitat Plan could include projects to enhance fish and wildlife habitat, stonnwater management, and wetland restoration. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY RESOL VB AS FOLLOWS: RESOLUTION SECTION 1. -Process for Adoption. The City Council authorizes the Mayor to direct the Public Works Department to investigate, analyze, and propose a comprehensive Habitat Protection and Restoration Plan for the City of Kent to identify, enhance and preserve significant critical areas in Kent. The City Council authorizes the Mayor to direct the Public Works Department to prepare a scope of work for the Habitat Protection and Restoration Plan and report back to the City Council on or before August 31, 2005. It is anticipated that the Habitat Protection and Restoration Plan scope will include the following elements: A. evaluate the City of Kent's landscape with respect to fish and wildlife habitat including wetlands, open space, and surface water; B. identify and rank the needs and opportunities for protection and restoration; C. propose solutions for areas identified as needing additional protection or restoration; D. provide cost estimates for the proposed solutions; E. monitor the results to gauge the effect of protection and restoration measures implemented; and F. apply adaptive management practices to ensure the effectiveness and vitality of the Habitat Protection and Restoration Program. 2 Habitat Protection and Restoration Plan SECTION 2. -Severability. If any section, subsection, paragraph, sentence, clause or phrase of this resolution is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this resolution. SECTION 3. -Effective Date. This resolution shall take effect and be in force immediately upon its passage.
