A RESOLUTION of the Ctty Counctl of the City of
Kent, Washington, authonztng applicatton to the
Interagency Committee for Outdoor Recreatton {lAC) for
state funding asststance for a Washington Wildlife and
Recreation Program ("WWRP"), as provided in Ch. 79A.15
RCW.
RECITALS
A. The City of Kent has approved a comprehensive plan that includes the
Eagle Creek Park development project.
B. Under the provtstons of the WWRP, state funding assistance has been
requested to aid in financing the development cost of the Eagle Creek Park
C. The City of Kent considers it in the best public interest to complete the
development project described in the application in order to develop the Eagle Creek
Park area.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS·

RESOLUTION
SECTION 1. -Appltcation. The City's director of Parks, Recreation, and
Community Services is authorized to make formal application to lAC for fundmg
assistance.
SECTION 2. -Use of Funds Any fundmg ass1stance received Will be used for
the Implementation of the project referenced above, wh1ch IS the development of the
Eagle Creek Park area.
SECTION 3. -Non-cash Commitments. The City of Kent acknowledges that it
is responsible for supporting all non-cash commitments to the sponsor share should
they not materialize.
SECTION 4. -Use Retained in Perpetuity. The City of Kent acknowledges that
any property acquired or facility developed with lAC financial a1d must be placed in use
as an outdoor recreation facility and be retained in such use in perpetuity unless
otherw1se provided and agreed to by the City of Kent and lAC.
SECTION 5. -Resolution -Part of Application. This resolution may become
part of a formal application to lAC.
SECTION 6. -Publtc Comment. The C1ty of Kent prov1ded opportunity for
public comment on this application at a Parks Comm1ttee public meeting on February
19,2004.
SECTION 7. -Severability. If any section, subsection, paragraph, sentence,
clause or phrase of this resolution IS declared unconstitutional or mvahd for any
reason, such dec1s1on shall not affect the validity of the rema1mng port1ons of th1s
resolution.

SECTION B. -Ratification Any act consistent with the authority and prior to
the effective date of this resolution is hereby ratified and affirmed.
SECTION 9. -Effective Date. This resolution shall take effect and be in force
immediately upon its passage.
PASSED at a regular open public meeting by the C1ty Council of the City of Kent,
Washington, this tf day of May, 2004.
