THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS SECTION 1. It IS the mtent10n of the C1ty Council of the C1ty of Kent, Washmgton, to order the Improvement of the properties w1thm the area descnbed m Exh1b1t "A," attached hereto and by th1s reference made a part hereof, by the constructiOn of an 8" sanitary sewer system With 6" side sewer stubs to the property hne for each of the six ( 6) properties mcluded m the proposed local Improvement d1stnct, as more fully descnbed m Exhibit "B," attached hereto and by this reference made a part hereof All of the foregomg Improvements shall be m accordance w1th the plans and specificatiOns therefore prepared by the Director of Public Works of the City and may 1 Proposed LID 357 -llo'h Place SE Sanitary Sewer-Set Hearing Date be modified by the C1ty as long as that mod1ficatwn does not affect the purpose of the improvements. SECTION 2. The total estimated cost and expense of the improvements 1s declared to be $101,700, and approxunately $11,700 of that cost and expense shall be pmd by the C1ty and the balance thereof (an estimated $90,000) shall be borne by and assessed agamst the property specially benefited by the Improvements to be mcluded m a local improvement d1stnct to be established embracmg as nearly as practicable all the property spec~ally benefited by the improvements Actual assessments may vary from estimated assessments as long as they do not exceed a figure equal to the mcreased true and fmr value the Improvements add to the property SECTION 3. The C1ty Clerk IS authonzed and directed to g1ve notice of the adoptwn ofth1s resolutwn and of the date, time, and place fixed for the pubhc heanng to each owner or reputed owner of any lot, tract, parcel of land, or other property w1thm the proposed local improvement d1stnct by mmhng such no !ice at least fifteen ( 15) days before the date fixed for pubhc heanng to the owner or reputed owner of the property as shown on the rolls of the Kmg County Assessor at the address shown thereon, as reqmred by law The C1ty Clerk also IS authonzed and d1rected to g1ve no !ice of the adoptiOn of tlus resolutwn and of the date, lime, and place fixed for the pubhc heanng to each owner or reputed owner of any lot, tract, parcel of land, or other property outs1de of the proposed local improvement d1stnct that IS reqmred by the Federal Housmg Admm1stratwn as a condition of loan qual1ficatwn to be connected to the proposed unprovements, by mmlmg such notice at least fifteen (15) days before the date fixed for 2 Proposed LID 357 -12rfh Place SE Sanitary Sewer-Set Hearing Date the public hearmg to the owner or reputed owner of the property as shown on the rolls of the County Assessor at the address shown thereon, as reqmred by law Th1s resoluhon also shall be published m 1ts enhrety m at least two (2) consecuhve 1ssues of the offic1al newspaper of the C1ty, the date of the first pubhcatwn to be at least fifteen (15) days pnor to the date fixed for the public heanng SECTION 4. All persons who may deme to comment m support of or object to the Improvements are nohfied to appear and present those comments or objectwns at a heanng before the C1ty Counc1l to be held m the Counct! Chambers m the C1ty Hall m Kent, Washmgton, at 7 00 p m on September 16, 2003, wh1ch t1me and place are fixed for heanng all matters relatmg to the Improvements and all comments thereon and objectwns thereto and for determ1mng the method of payment for the Improvements All persons who may deme to object thereto should appear and present the1r objectwns at that heanng. Any person who may des1re to file a wntten protest w1th the C1ty Counc1l may do so w1thm th1rty (30) days after the date of passage of the ordmance ordenng the Improvements m the event the local Improvement d1stnct 1s formed The wntten protest should be s1gned by the property owner and should mclude the legal descnptwn of the property for wh1ch the protest 1s filed and that protest should be dehvered to the C1ty Clerk SECTION 5. The City's D1rector ofPubhc Works 1s d1rected to subm1t to the C1ty Counc1l on or pnor to September 16, 2003, all data and mformahon reqmred by law to be subm1tted 3 Proposed LID 357 -12fJh Place SE Sanitary Sewer-Set Hearmg Date SECTION 6. If any sectiOn, subsectiOn, paragraph, sentence, clause, or phrase of tlus resolutiOn IS declared unconstitutiOnal or mvahd for any reason, such declSlon shall not affect the vahd1ty of the remammg portiOns of this resolution SECTION 7. Any act consistent with the authonty and pnor to the effective date of this resolutiOn IS hereby ratified and affirmed SECTION 8.
