SECTION 1. It IS the mtent10n of the city council of the city of Kent, Washmgton, to order the Improvement of the properties Wlthm the area descnbed m Exhibit "A," attached hereto and by this reference made a part hereof, by the constructiOn of an 8" samtary sewer system With 6" side sewer stubs to the nght of way !me, as more fully descnbed m Exhibit "B," attached hereto and by this reference made a part hereof All of the foregomg Improvements shall be m accordance with the plans and specificatiOns therefore prepared by the Director ofPubhc Works of the City and may be modified by the city as long as that modification does not affect the purpose of the nnprovements 1 Proposed LID -11 I'• Ave. Sanitary Sewer August 19, 2003, Heanng Date SECTION 1. The total estunated cost and expense of the improvements IS declared to be $256,500, and approximately $91,500 of that cost and expense shall be prud by the c1ty and the balance thereof (an estJmated $165,000) shall be borne by and assessed agamst the property specmlly benefited by the improvements to be mcluded m a local improvement d1stnct to be established embracmg as nearly as practJcable all the property specially benefited by the improvements. Actual assessments may vary from estJmated assessments as long as they do not exceed a figure equal to the mcreased true and farr value the improvements add to the property. SECTION 3. The c1ty clerk IS authonzed and directed to g1ve notice of the adoptwn ofth1s resolutiOn and of the date, time and place fixed for the pubhc heanng to each owner or reputed owner of any lot, tract, parcel of land or other property w1thm the proposed local improvement d1stnct by mailmg such not1ce at least fifteen days before the date fixed for pubhc heanng to the owner or reputed owner of the property as shown on the rolls of the Kmg County Assessor at the address shown thereon, as reqmred by law. The city clerk also 1s authonzed and drrected to gJVe notice of the adoption of th1s resolution and of the date, time and place fixed for the pubhc heanng to each owner or reputed owner of any lot, tract, parcel of land or other property outside of the proposed local improvement d1stnct that IS reqmred by the Federal Housmg Adm1mstratwn as a comhtlon of loan quahficatwn to be connected to the proposed improvements, by mailmg such not1ce at least fifteen (15) days before the date fixed for the pubhc heanng to the owner or reputed owner of the property as shown on the rolls of the County Assessor at the address shown thereon, as requrred by law. 2 Proposed LID -111,. Ave. Sanitary Sewer August 19, 2003, Heanng Date This resolution also shall be pubhshed m its entuety m at least two (2) consecutive 1ssues of the offic1al newspaper of the c1ty, the date of the fust pubhcat10n to be at least fifteen (15) days pnor to the date fixed for the pubhc heanng. SECTION 4. All persons who may desrre to comment m support of or obJect to the Improvements are notified to appear and present those comments or obJections at a hearmg before the c1ty counctl to be held m the Counc1l Chambers m the C1ty Hall m Kent, Washmgton, at 7 00 p.m on August 19, 2003, wh1ch time and place are fixed for heanng all matters relatmg to the Improvements and all comments thereon and obJectiOns thereto and for detenmmng the method of payment for the Improvements All persons who may deme to obJect thereto should appear and present the1r obJectiOns at that heanng Any person who may deme to file a wntten protest with the c1ty counc1l may do so wtthm tlurty (30) days after the date of passage of the ordmance ordenng the Improvements m the event the local1mprovement d1stnct IS formed The wntten protest should be s1gned by the property owner and should mclude the legal descnpt10n of the property for wh1ch the protest 1s filed and that protest should be dehvered to the c1ty clerk. SECTION 5. The City's Duector of Public Works IS duected to subm1t to the c1ty counctl on or pnor to August 19, 2003, all data and mformat10n reqmred by law to be subm1tted. SECTION 6. If any sect10n, subsection, paragraph, sentence, clause, or phrase of th1s resolution IS declared unconstitutiOnal or mvahd for any reason, such declSlon shall not affect the vahd1ty of the rematmng port10ns of tlus resolutiOn. 3 Proposed LID -11 t• Ave. Sanitary Sewer August 19, 2003, Hearing Date SECTION 7. Any act consistent with the authonty and pnor to the effective date of this resolution IS hereby ratified and affirmed. SECTION 8. This resolutiOn shall take effect and be m force nnmedJately upon Its passage.
