I (p 0 b A RESOLUTION of the City of Kent, Washington, (1) regarding the vacation of a portion ofS. 206th Street, lying generally in the southeast quarter of the southeast quarter of Section 1, Township 22 North, Range 4 East, W.M. in King County; (2) repealing Resolution No. 1604, which originally set the public hearing on this petition more than 60 days from the passage date of the resolution; and (3) setting the public hearing on the proposed street vacation for November 20, 2001, which is less than 60 days and more than 20 days from the passage of this resolution. WHEREAS, Resolution No. 1604 was passed on September 18, 2001, which set the hearing date on the S. 206h Street vacation petition for November 20, 2001; and WHEREAS, pursuant to Kent City Code 6.09.010, the public hearing on a street vacation petition shall be held no more than 60 days and no less than 20 days after the passage date of the resolution setting the hearing date; and WHEREAS, Resolution No. 1604, was passed more than 60 days prior to the date of the hearing. Therefore, it is necessary to repeal the prior resolution and adopt this new resolution in order to comply with the requirements ofKCC 6.09.010; and WHEREAS, the petition, attached as Exhibit A, has been filed by Specialty Metals to vacate a portion of S. 206th Street, a deeded street lying generally in the southeast quarter of the southeast quarter of Section 1, Township 22 North, Range 4 1 Street Vacation- S. 206th Street East, W.M. in the City of Kent, King County, Washington; and WHEREAS, the petition is signed by the owners of at least two-thirds of the real property abutting that portion of S. 206th Street and East Valley Highway that is now being sought to be vacated; and WHEREAS, the petition is in all respects proper; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Resolution No. 1604, passed on September 18, 2001, is hereby repealed in its entirety. SECTION 2. A public hearing on the street vacation petition requesting the vacation of a portion of S. 206th Street shall be held at a regular meeting of the Kent City Council at 7:00p.m., Tuesday, November 20, 2001, in the Council Chambers of City Hall located at 220 4th Avenue South, Kent, Washington, 98032. SECTION 3. The City Clerk shall give proper notice of the hearing and cause the notice to be posted as provided by state law, Ch. 35.79 RCW. I I I I I I 2 Street Vacation - S. 206th Street SECTION 4.
