RESOLUTION NO. 3%2--
WHBREAS, the City of Kent heretofore made and entered
into a contract with Valley Construction Company, dated September
13, 195~, for certain work in said contract described, and
WHEREAS, the said contractor has refused and failed to
prosecute the work and now refuses and fails to complete the
contract in accordance with the terms and specifications thereof, ,
and
WHEREAS, such neglect, failure and refusal of the contractor
is sufficient grounds to forfeit said contract, and
WHEREAS, it is apparent that litigation upon said contract
and upon the forfeiture thereof is probable,
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Kent, in regular meeting assembled, as follows:
1. That the legal form of Elvidge,watt,Veblen and Tewell
be and it is'hereby retained by the City of Kent as special
associate counsel of said City for the purpose, with the City
Attorney, of partlcipating in negotiations, consultations and
in advising on matters relating to said contract, and for the
purpose of instituting and maintaining all proceedings necessary,
or of defending any proceedings instituted by others in
connection with said contract.

day of July, 1957.
