RESOLUTION NO. ~
WHEREAS, VALLEY CONSTRUCTION COMPANY, Contractors, under
Contract I-Trunk sewer, dated September 13, 1956, has refused
and failed to prosecute the work of said contract with such
diligence as will insure its completion within the time
specified in the contract, and all extensions of time, and
specifically the completion date has now passed and the contractor
has done no work whatsoever in connection with the completion
of the work since May 17, 195'7, and
WHEREAS, the contractor has failed and neglected to
complete the 15 inch and 18 inch sewer lines from North Park
Lift Station (Manhole 14) to Manhole 1, in that the contractor
has failed and neglected to clean and repair the said lines for
final inspection and examination, and
WHEREAS, there are many known defects in the said line
which have heretofore been pointed out to the contractor, which
have been apparent to visual observation such as excessive
infiltration, settlement, voids in the fill, misalignment of
the pipes, loss of grade and sand and other debris and plugging
in the pipes, and
WHEREAS, the defects in the said line cannot be fully
ascertained and determined until the proper corrective measures
known to the contractor have been made and the line cleaned
for the purpose of inspection, and
WHEREAS, the failure of the contractor to clean and prepare
the pipe for inspection and correction of defects, which said
inspection may disclose, makes impossible the placing of the
line a~ operation, to the damage of the City, and
WHEREAS, it appears necessary to the City to give notice
of intention to forfeit said contract unl~s violations of the
contract shall cease and satisfactory arrangements for the
correction thereof by the contractor be made.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Kent in regular meeting assembled, that the Mayor and

the City Clerk of the City of Kent be and they are hereby
authorized to execute and cause to be served upon Valley
construction company, at 7722 Rainier Avenue, seattle, washington,!
