WHEREAS, the sidewalk upon the West side of First Avenue, as
presently constructed, encroaches upon the following described real
property situate in the CITY OF KENT, to-wit:
and
Lot Two (2) in Block twenty-four (24), of Yesler's First
Addition to the Town of Kent, according to the plat thereof
recorded in the office of the Auditor of said County in Volume 5
of Plats, at page 64, EXCEPT the North six inches ( f:Jt) thereof
measured along the Easterly line, and EXCEPT the West eight (8)
feet thereof heretofore conveyed to the City of Kent for alley
purposes.
Lot numbered Three (3) and the north six inches of Lot
numbered Two (2), in Block numbered Four (4), of H. L. Yesler•s
First Addition to the Town of Kent, as per plat or map recorded
in Volume 4 of Plats, page 35, records of the Auditor's Office;
which said real property is also known as Lot numbered Three (3)
and the north six inches of Lot numbered Two (2), in Block number
Twenty-four (24), of Yesler 1 s First Addition to the Tow.n of Kent,
as per plat or map recorded in Volume 5 of Plats, page 64, records
of the said Auditor's office;
SAVE AND EXCEPT the westerly eight feet (8') thereof, heretofore
conveyed to the Town of Kent by instrument bearing Auditor •a
File No. 464086
~ffiEREAS, the CITY OF KENT has no right, title or interest in
or to said real property, but the encroachment of said sidewalk
thereon constitutes an apparent defect in the title thereto;
NOW, THEREFORE,
BE IT RESOLVED by the City Council of the CITY OF KENT, that
the City of Kent disclaim all right, title and interest of, in
or to the real property hereinabove described and that the proper
officers of the City of Kent be and they are hereby authorized
and directed, in the name and on behalf of the City of Kent, to
execute and deliver such instrument in writing as shall effectually
disclaim any right, title or interest in or to said real property.
