IVHEREAS, the City Council deem it advisable to apply :lfor grant moneys under the ~,\7 ater and Sewer Facilities Grant ~ l llProgram of the Department of Housing and Urban Development of the liUni ted States of America; and I; ii WHEREAS, as a condition of any such grant, an applicant li i~nust make a policy statement relating to the acquisition of real ' '! : ~roperty in connection with the development of any such project I' i! :lso fj_nanced; NO\v, THEREFOHE, !I II BE IT RESOLVED BY THE CITY COUNCIL OF KENT, KING COUNTY, rv'ASHINGTON, as follov1s: !I '• ij In connection with any construction project financed in ., h ~art with grant moneys from the Department of Housing and Urban il ~Development of the United States of America, it is the policy of 'I ~the District with respect to the acquisition of real property of II ~interests therein relating thereto, as follows: ii 1. ') ...... :! It will make every reasonable effort to acquire the real property by negotiated purchase before instituting eminent domain proceedings. It will not require any owner to surrender possession of real property until the appli- cant pays, or causes to be paid, to the mm er (a) the agreed purchase price arrived at by negotiation, or (b) in any case where only the amount of the pa.yment to the mm er is in dispute, not less than 75 percent of the appraised fair value as approved by the applicant and concurred in by the Department of Housing and Urban Jevelopmcnt. 1 2 3 4 5 J.
