2 WHEREAS, for many years, the Street Department of the City
3 of Kent, Washington, has installed surface drainage title in the
4 public right-of-way, if the adjacent property owner purchased the
5 tile; and
6 WHEREAS, it has now become too expensive for the City of
7 Kent to continue such a policy; and
8 WHEREAS, it is in the best interests of the Citizens of
9 the City of Kent that utilization Df side-sewer contractors be
10 made for this type of project for the purpose of avoiding liability
11 on the part of the property owner for constructing within the
12 public right-of-way and for the further reason that the side-sewer
13 contractors are bonded and licensed by the City of Kent;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF KENT, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, AS
FOLLOWS:
I.
Effective immediately, the City of Kent will not install
tile for the control of the surface drainage for individuals in
public rights-of-way.
II.
Any property owner desiring to install drainage tile in
public rights-of-way may do so if he:
(a} Purchases the tile;and
(b) Hires a licensed side-sewer contractor to make
such installation~ in accordance with the Ordin-
ances of the City of Kent.
PASSED AT A REGULAR MEETIN of the Kent City Council this
~day of June, 1969.
