WHEREAS, pursuant to Ordinance No. 1550, a condemnation
suit is presently pending in King County Superior Court, cause
706251, wherein the City seeks to acquire certain property for
no.!
I
I the:
improvement of James Street; and
WHEREAS, the Petition in said suit, as to property of
j Clarence L. Olson and Barbara Olson, his wife, designated therein
I
:/as Parcel T-58, provides for acquisition of a specific portion
II
!I thereof for the improvement of James Street; and
WHEREAS, the partial appropriation of Parcel T-58 was
based on installation of a retaining wall within the area to be
I appropriated by the City; and
WHEREAS, the Office of the City Engineer and the City•s
firm of consulting engineers have now reported to the Council that
1 the proposed retaining wall will present a potential traffic
l
I hazard involving reduced sight distance and that the cost of de-
l
I sign and construction of the retaining wall will exceed the total
I value of the entire Olson ownership, designated Parcel T-58; and
I I WHEREAS, to substitute the required slope in place of the
I
I proposed retaining wall, it is necessary that the entire Olson
ownership, designated Parcel T-58, be appropriated.

IINGTON,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASH
IN A REGULAR MEETING DULY ASSEMBLED, DO HEREBY RESOLVE
AS FOLLO~JS :
hereby further directed to proceed to amend the City•s Petition
in King County Superior Court, cause No. 706251, to effect such
appropriation.
