CITY OF KENT, WASHINGTON
RESOLUTION NO. -£:7 g
A RESOLUTION of the City Council of the
City of Kent, Washington, stipulating the agree-
ment of the City Council to certain conditions
and limitations to the approval of the Economic
Development Administration of the new design
concept of the North Kent Industrial Area sewers
and the City's Agreement for Sewage Disposal
with the Municipality of Metropolitan Seattle,
as amended.
WHEREAS, the City and the Municipality of Metropolitan Seattle
(METRO) entered into an Agreement for Sewage Disposal, dated May 18,
1967, and an amendment thereto, dated June 5, 1967, which Agreement,
as amended, would result in a change in the design concept of the
sanitary sewers located in the North Kent Industrial Area, but vyhich
Agreement, as amended, was conditioned on the approval of the Economic
Development Administration before it becomes effective; and
WHEREAS, by letter, dated July 13, 1967, and relating to
E. D. A. Project No. 07-1-00103, the Economic Development Administration
has approved the aforesaid change of design concept and Agreement, as
amended, conditioned on the adoption by the City Council of a Resolution
stipulating the agreement of the City Council to certain conditions and
limitations to the Economic Development Administration approval; and
WHEREAS 1 the City Council desires to adopt such a resolution;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON 1 as follows:
The City of Kent hereby accepts and approves the approval by
the Economic Development Administration of the aforesaid change of design
concept of the North Kent Industrial Area sewer system and the Agreement
for Sewage Disposal with the Municipality of Metropolitan Seattle, as
amended, which Economic Development Administration approval related to
Economic Development Administration Project No. 07-1-00103, and more
specifically the City Council stipulates agreement to the following
conditions and limitations contained in the aforesaid Economic Development
Administration approval:
a. Title of ownership of all facilities constructed
and provided in part by the application of grant funds
provided for said project by EDA, shall remain with the
City of Kent and will not be sold or conveyed to METRO
directly or indirectly without the express approval of
the Economic Development Administration or other
authorized agency of the United States Government
which has the authority to grant such approval.
b. The City of Kent understands and agrees that
the grant of $2,75 9, 000 made by EDA to the City for
construction of said project on May 24, 19 6 6, and
accepted by the City on June 2, 1966, is the total
of such grant funds to be made available for said
project and that the City will furnish additional funds
to pay all costs of the project in excess of the original
approved project cost estimate of $5,518,000.
c. The full costs for engineering services for the
redesign of the project will be paid by the City from
its own funds which are not a part of the $5,518,000
originally approved project cost estimate.
ADOPTED at a regular meeting of the City Council of the City
of Kent and APPROVED by the Mayor, this 17th day of July, 1967.
