WHEREAS, the City of Kent entered into a contract with
Capital Construction Co., Inc., a Washington Corporation, on the
11th day of August, 1959, providing for the construction by said
company of certain water mains and other facilities in connec-
tion with the erection of a certain housing development in the
vicinity of the City of Kent, and
WHEREAS, such agreement provided that upon the completion of
at least seventy-six (76) residences by such company, and connec-
tion of such residences to the water and sanitary facilities to
be constructed by such company under the terms of such agreement,
that the maintenance of such facilities should be assumed by the
City and steps taken to transfer title from such company to the
City of Kent, and
WHEREAS, such company now advises that the requisite number of
residences have been connected, constructed and so connected to
such water facilities, and all such water and sewer facilities
contemplated by said agreement are in place md in every manner
conform to the requirements of the City of Kent, and
WHEREAS, the City Engineer of the City of Kent has concurred
in this representation by such company, and
WHEREAS, such company has presented to the City Council of
the City of Kent a Bill of Sale duly acknowledged, purporting to
transfer and convey all its title and interest in those certain
water and sewer facilities which were constructed by the company
pursuant to the agreement of August 11, 1959, and
WHEREAS, the City Council of the City of Kent at its regular
meeting on November 21, 1960, duly moved to accept the Bill of Sale
to such personal property, NOW, THEREFORE, it is hereby resolved
that the Bill of Sale executed by the president and assistant

secretary of Capital Construction Company-, Inc., on the 21st day
of November, 1960, be and it is hereby accepted by the City of Kent-
PASSED BY THE CITY COUNCIL in regular meeting assembled this
