HomeMy WebLinkAbout854RESOLUTION NO. ~~~ A RESOLUTION of the City Council of the City of Kent, Washington estab- lishing and reaffirming the policies of the City regarding water service from transmission lines and establish- ing time schedules for discontinuing such service. WHEREAS the City of Kent owns and operates two water transmission lines, the purpose for which is to transport large quantities of water from springs and wells located several miles east of Kent to reservoirs located on the east hill of Kent from which reservoirs the water enters the distribution main system, WHEREAS it is necessary to provide maximum water flow through the transmission lines to maintain suf- ficient water in the reservoirs for customers served by the distribution main system and for fire protection, and WHEREAS it is not possible to provide suffi- cient water flow into the reservoirs without causing low and negative pressures in the transmission lines, which pressures may also occur in the customer service lines con- nected to the transmission lines, and WHEREAS low and negative pressures in customer service lines may allow ground water or surface water to ~·c­ enter those lines through leaks and breaks in the service lines and may contaminate both the water in the customer's system and in the transmission line, creating a potential health hazard, NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF KENT, WASH- INGTON, DO HEREBY RESOLVE AS FOLLOWS: Section 1. New Connections. The informal Kent policy to refuse new service connections to transmis- sion lines which has been followed for the past several years is hereby reaffirmed and adopted. Section 2. Inactive Connections. No water service will be provided through existing water service connections to transmission lines where the service has not been used for a period of six months or more. Section 3. Active Connections. It is the policy of the City of Kent to require all active water service connections to transmission lines to be discontin- ued. It is recognized that customers using such service connections will require time to arrange for other service. The maximum time allowed after the receipt of written no- tice is as follows: A. Kent Water Distribution Main Available. Where an existing Kent water distribu- tion main is available or will be avail- able after the payment of a latecomer fee or a payment in lieu of assessment, trans- mission lines service shall terminate in six months. B. Kent Franchise Area Without A Main Available. Where the property service is within Kent or within the Kent franchise area but no water distribution main is presently available without extension, transmission line service shall terminate in six months, except that if reasonable progress has been made to extend the main, an extension of not more than twelve months can be granted with City Council approval. C. Water District Franchise Area. Where the property served is within the franchise area of the water district, transmission line service shall terminate in six months, ex- cept that if reasonable progress has been made with the district but service from the district cannot be obtained within the six month period, a time extension can be grant- ed with City Council approval. D. Other Areas. Where the property served is not within Kent, the Kent franchise area - 2 - or a water district franchise area, each customer shall, within six months, make arrangements for other service with a date certain at which the present service will be terminated. If the customer fails to make arrangements or fails within six months to obtain City approval for the date at which transmission line service will termi- nate, then service shall terminate in six months. E. Contract Customers. Should it be de- termined that any present customer receiv- ing water from a transmission main is doing so through a legal contract, a date certain for disconnection will be negotiated.
