A RESOLUTION of the City Council
of the City of Kent, Washington, accepting
the terms of an agreement assigning an ease-
ment to the City of Kent and authorizing the
Mayor to sign said agreement.
WHEREAS, Puget Sound Power and Light Company ( "Puget")
has granted an easement to Union Pacific Land Resources Cor-
poration ("Assignor") for the purpose of constructing and
maintaining a storm sewer system across Puget's right-of-way
adjacent to an area of the City of Kent known as "Uplands
Plat", and
WHEREAS, Assignor has installed said storm sewer system
as part of the improvements of the plat, and
WHEREAS, the City is prepared to accept ownership and
maintenance responsibilities of said storm sewer and to con-
tinue to operate and maintain it as a public facility of the
City, and
WHEREAS, in order for the City to assume ownership and
maintenance control over the system, it will be necessary for
Assignor to assign the easement to the City, and
WHEREAS, Puget and Assignor have agreed to assign said
easement to the City, and
WHEREAS, an agreement has been prepared among Puget,
Assignor and City of Kent covering assignment of the easement
to the City of Kent, and
WHEREAS, said agreement has been reviewed by the Di-
rector of Public Works, the City Attorney and had been duly
considered at a regular open public meeting of the Kent City
Council, and
WHEREAS, it is considered that the best interest of
the City of Kent will be subserved by accepting said agreement,
NOW, THEREFORE
BE IT HEREBY RESOLVED AS FOLLOWS:
1. That the terms of the agreement among Union
Pacific Land Resources Corporation, Puget Sound
Power and Light Company, and the City of Kent
referred to above be and the same are hereby ac-
cepted on behalf of the City of Kent.
2. The Mayor of the City of Kent is hereby autho-
rized and directed to execute said agreement on
behalf of the City of Kent.
3. The City Clerk is hereby authorized and directed
to attest said agreement and to attach to each
original counterpart of said agreement a certi-
fied copy of this Resolution
PASSED at a Regular Meeting of the Kent City Council
this 4th day of April, 19 77. . .
