HomeMy WebLinkAbout769RESOLUTION NO. A RESOLUTION of the City Council of the City of Kent, Washington, re- garding furnishing of utilities services outside the corporate limits of the City. WHEREAS, the City Council of the City of Kent, Wash- ington, has determined that it would be advisable to have a written policy governing the furnishing of sewer and water services outside its corporate limits, and WHEREAS, there are three (3) general categories of requests for utility services outside the City, to-wit: and, 1. Utility lines available and service has been previously committed, 2. Utility lines available and service has not been previously committed, 3. Utility lines not available without extension, WHEREAS, a specific procedure for handling requests in each of the three categories needs to be established to eliminate confusion and to provide direction and guidance to City Staff and to applicants for services, NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS: 1. The following procedures are hereby established for processing applications for utility services outside the corporate limits of the City of Kent; a. In areas where utility lines are available and service has been previously committed prior to the effective date of this Resolution, the service may be provided upon proper application without specific City Council action. -1- b. In areas where utility lines are available and service has not been committed prior to the effective date of this Resolution, the determi- nation as to whether to provide service shall depend upon the capacity of the utilities systems to serve the area, and the feasibility of annexa- tion of the area to the City. If the systems have the capacity and annexation is feasible, then service may be provided only after the area is annexed to the City. If the systems have the capacity to serve the area and annexation is not feasible, then in that event only those locations upon which structures exist or for which building permits have been issued as of the effective date of this Resolution may be served. Any new con- struction will not be served unless the area is annexed. c. In areas where utilities lines are not available, no consideration will be given to any requests for utility services until after the person requesting the service has applied to the King County Boundary Review Board and has received approval for the extension. Following said Board approval, the City Council or the appro- priate committee thereof may consider the request. In the case of properties abutting or in close proximity to the City limits, the general rule shall be that annexation to the City shall be required prior to the furnishing of services. For areas more remote from the City, the City Council shall determine when annexation shall be required before service may be provided.
