HomeMy WebLinkAbout1167CITY OF KENT, WASHINGTON RESOLUTION NO. /f~}t A RESOLUTION of the City Council of the City of Kent, Washington, declaring its intention to order the installation of sanitary sewers, side sewers and necessary appurtenances on 12lst Avenue S.E., l22nd Avenue S.E. and S.E. 276th Street outside the City and to create a local improvement district to assess the cost and expense of carrying out such improvements against the properties specially benefited thereby, and notifying all persons who desire to object to the improvements to appear and present their objections at a hearing before the City Council to be held on May 17, 1988. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, as follows: Section 1. It is the intention of the City Council of the City of Kent, Washington, to order the improvement of the properties outside the City within the area described in Exhibit A, attached hereto and by this reference made a part hereof, by the installation of 8" sanitary sewers, 6" side sewers and related appurtenances as follows: ON 12lst Ave. SE l22nd Ave. SE SE 276th St. Easement between Lots 6 and 7 FROM SE 276th St. SE 274th St. l20th Ave. SE SE 276th St./122nd Ave. SE Intersection TO Cul-de-Sac North of SE 276th St. SE 276th St. l22nd Ave. SE Existing manhole approximately 135' Southeasterly All of the foregoing improvements shall be in accordance with the plans and specifications therefor prepared by the City Engineer and may be modified by the City as long as such modification does not affect the purpose of the improvement. Section 2. The total estimated cost and expense of the improvement is declared to be $135,200 and the entire cost and expense thereof shall be borne by and assessed against the property specially benefited by such improvement to be included in a local improvement district to be established embracing as nearly as practicable all the property specially benefited by the improvement. Section 3. All persons who may desire to object to the improvement described herein are notified to appear and present such objections at a hearing before the City Council to be held in the Council Chambers in the City Hall in Kent, Washington, at 7:00p.m., local time, on May 17, 1988, which time and place are fixed for hearing all matters relating to the proposed improvement and all objections thereto and for determining the method of payment for the improvement. All persons who may desire to object thereto should appear and present their objections at such hearing. Any person who may desire to file a written protest with the City Council may do so within thirty days after the date of passage of the ordinance ordering the improvement in the event the local improvement district is formed. Such written protest should be signed by the property owner, should include the legal description of the property for which the protest is filed and should be delivered to the City Clerk. Section 4. The City Clerk is authorized and directed to give notice of the adoption of this resolution and of the date, time and place fixed for the public hearing to each owner or reputed owner of any lot, tract, parcel of land or other property within the proposed local improvement district by mailing such notice at least fifteen days before the date fixed for public hearing to the owner or reputed owner of the property as shown on the tax rolls of the King County Department of Finance at the address shown thereon, as required by law. The City Clerk also is authorized and directed to give notice of the adoption of this resolution and of the date, time and place fixed for the public hearing to each owner or reputed owner of - 2 - any lot, tract, parcel of land or other property outside of the proposed local improvement district that is required by the Federal Housing Administration as a condition of loan qualification to be connected to the proposed improvements, by mailing such notice at least fifteen days before the date fixed for the public hearing to the owner or reputed owner of the property as shown on the tax rolls of the King County Department of Finance at the address shown thereon, as required by law. The City Clerk is directed to keep on file and make available for public perusal a list of the owners or reputed owners receiving either notice. This resolution also shall be published in at least two consecutive issues of the official newspaper of the City, the date of the first publication to be at least fifteen days prior to the date fixed for the public hearing. Section 5. The City's Director of Public Works is directed to submit to the City Council on or prior to May 17, 1988, all data and information required by law to be submitted. Passed at a regular public meeting by the City Council of the City of Kent, Washington, this 19th day of April, 1988.
