A RESOLUTION of the City Council of the City of Kent, Washington, allowing the limited outdoor burning of certain waste material and allowing certain land cleaning burning rescinding Resolution 1113. WHEREAS, by Resolution 1113 adopted October 6, 1986, the City of Kent prohibited outdoor burning except in limited circumstances; and WHEREAS, conditions have changed since the City's adoption of Resolution 1113; and WHEREAS, in the judgment of the Fire Chief of the City of Kent, it would now be appropriate to allow outdoor burning of natural vegetation under carefully controlled circumstances and on a limited basis during the year; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Residential. Outdoor burning of natural vegetation (trees, shrubs, etc.) shall be allowed for the purpose of residential burning upon issuance of a permit. A. Residential burning is defined as small outdoor fires consisting of leaves, clipping, prunings, and wood so long as it has not been treated by an application of prohibitive material or substances and other yard and gardening refuse originating on lands immediately adjacent and in close proximity to a human dwelling and burned on such lands by the property owner or his designee. B. Residential burning shall only be allowed by complying with the following conditions: 1. Fires are conducted only by the resident of a single family residence. 2. Fires are started only between 10 a.m. and sunset. 3. Only one pile is burned at a time and each pile is extinguished before another is lighted. 4. No burning is conducted within fifty feet of any structure. 5. The fires contain only natural vegetation and wood so long as it has not been treated by an application of prohibitive material or substances. c. Permits. A permit shall be required for each burning operation. Permits shall be issued by the Fire Chief or his designate. All burning must be done in accordance with rules and regulations of the Kent Fire Department, Puget Sound Air Pollution Control Agency, and any other department or agency which may now or at any future date have jurisdiction or control of outdoor burning. Section 2. Land clearing burning of natural vegetation shall be allowed upon issuance of a permit. A. Land clearing is defined as outdoor fires consisting of residue of a natural character such as trees, stumps, shrubbery or other natural vegetation arising from land clearing projects and burned on the lands on which the material originated. B. Land clearing shall only be allowed by complying with the following conditions: 1. A permit is obtained from Air Pollution Control (valid for one year). 2. A land clearing permit is obtained from the Kent Fire Department (valid for 2 weeks and is renewable). 3. All rules and regulations from both Air Pollution and the Kent Fire Department are followed. - 2 - Section 3. Resolution 1113 be and the same is hereby rescinded.
