HomeMy WebLinkAbout1151CITY OF KENT, WASHINGTON RESOLUTION NO. //5/ A RESOLUTION of the City Council of the City of Kent, Washington, declaring its intention to order the widening and improvement of SE 240th Street from l08th Avenue SE to ll6th Avenue SE and to create a local improvement district to assess the cost and expense of carrying out such improvements against the properties specially benefited thereby; fixing the date, time and place for a public hearing on the formation of the proposed local improvement district; and directing the giving of notice thereof and notifying all persons who desire to object to the improvements to appear and present their objections at a hearing before the City Council to be held on November 17, 1987. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, as follows: Section 1. Intention to Order Improvements. It is the intention of the City Council of the City of Kent, Washington, to order the improvement of the properties within the area described in Exhibit A, attached hereto and by this reference made a part hereof, by the widening and improvement of SE 240th Street from 108th Avenue SE to ll6th Avenue SE as described in Exhibit B, attached hereto and by this reference made a part hereof. All of the foregoing improvements shall be in accordance with the plans and specifications therefor prepared by the Director of Public Works of the City and may be modified by the City as long as such modification does not affect the purpose of the improvements. Section 2. Estimated Cost and Expense of and Manner of Payment for Proposed Improvements. The total estimated cost and expense of the improvements is declared to be $1,440,900. Approximately $900,000 of such cost and expense shall be paid by the City and the balance thereof shall be borne by and assessed against the property specially benefited by such improvements to be included in a local improvement district to be established embracing as nearly as practicable all the property specially benefited by the improvements. Section 3. Hearing on Proposed Improvements and Formation of Local Improvement District; Objections and Protests Thereto. All persons who may desire to object to the improvements described herein are notified to appear and present such objec- tions at a hearing before the City Council to be held in the Council Chambers in the City Hall in Kent, Washington, at 7:00 p.m., local time, on November 17, 1987, which time and place are fixed for hearing all matters relating to the proposed improve- ments and all objections thereto and for determining the method of payment for those improvements. All persons who may desire to object thereto should appear and present their objections at such hearing. Any person who may desire to file a written protest with the City Council may do so within thirty days after the date of passage of the ordinance ordering the improvements in the event the local improvement district is formed. Such written protest should be signed by the property owner, should include the legal description of the property for which the protest is filed and should be delivered to the City Clerk. Section 4. Notice to Owners of Property Within Proposed Local Improvement District. The City Clerk is authorized and directed to give notice of the adoption of this resolution and of the date, time and place fixed for the public hearing to each owner or reputed owner of any lot, tract, parcel of land or other property within the proposed local improvement district by mailing such notice at least fifteen days before the date fixed for public hearing to the owner or reputed owner of the property as shown on the tax rolls of the King County Assessor at the address shown thereon, as required by law. The City Clerk is - 2 - directed to keep on file and make available for public perusal a list of the owners or reputed owners receiving the notice. This resolution shall also be published in at least two consecutive issues of the official newspaper of the City, the date of the first publication to be at least fifteen days prior to the date fixed for the public hearing. Section 5. Directing Submission of Data and Information. The City's Director of Public Works is directed to submit to the City Council on or prior to November 17, 1987, all data and information required by law to be submitted. STREET IMPROVEMENTS The project will include additional paving width to accommodate more lanes, 58 feet total width curb to curb. Also included are two way turn lane, overlay of existing pavement, drainage, curb and gutter, sidewalk, landscaping, illumination, signal improvements at 116th Ave SE, undergrounding of electrical facilities and utility adjustments and relocations as required. I, Brenda Jacober, Deputy City Clerk of the City of Kent, Washington, certify that the attached copy of Resolution No. 1!51 is a true and correct copy of the original resolution adopted on the 20th day of October, 1987, as that resolution appears on the Minute Book of the City.
