I 0 ~ A RESOLUTION of the City Council of the City of Kent, Washington, declaring its intention to order street, water main and sanitary sewer improvements to 104th Avenue S.E. (a/k/a Benson Highway) from the S.E. 242nd block to the S.E. 252nd block, both inside and outside of the City, and to create a local improvement district to assess a part of the cost and expense of carrying out such improvements against the properties specially benefited thereby, and notifying all persons who desire to object to the improvements to appear and present their objections at a hearing before the City Council to be held on February 3, 1986. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, as follows: Section 1. It is the intention of the City Council of the City of Kent, Washington (the "City"), to order the improvement of the properties, both inside and outside of the City, within the area described in Exhibit A, attached hereto and by this reference made a part hereof, by the street, water main and sanitary sewer improvements to 104th Avenue S.E. (a/k/a Benson Highway) from the S.E. 242nd block to the S.E. 252nd block as described in Exhibit B, attached hereto and by this reference made a part hereof. All of the foregoing improvements shall be in accordance with the plans and specifications therefor prepared by the City Engineer and may be modified by the City as long as such modifi- cation does not affect the purpose of the improvement. Section 2. The total estimated cost and expense of the improvements is declared to be $3,000,000. Approximately $403,125 of such cost and expense shall be borne by and assessed against the property specially benefited by such improvements to be included in a local improvement district to be established embracing as nearly as practicable all the property specially benefited by the improvements. Of the $403,125, $255,519.67 of such cost and expense is allocable to property within the proposed local improvement district but outside the boundaries of the City. The remaining cost and expense shall be paid by the City and State money available therefor. Section 3. All persons who may desire to object to the improvements described herein are notified to appear and present such objections at a hearing before the City Council to be held in the Council Chambers in the City Hall in Kent, Washington, at J:o~ ~.m. on February 3, 1986, which time and place are fixed for hearing all matters relating to the proposed improve- ments and all objections thereto and for determining the method of payment for those improvements. All persons who may desire to object thereto should appear and present their objections at such hearing. Any person who may desire to file a written protest with the City Council may do so within thirty days after the date of passage of the ordinance ordering the improvement in the event the local improvement district is formed. Such written protest should be signed by the property owner and should include the legal description of the property for which the protest is filed and such protest should be delivered to the City Clerk. Section 4. The City's Director of Public Works is directed to submit to the City Council on or prior to February 3, 1986, all data and information required by law to be submitted. Street Improvements {S.E. 242nd Block to S.E. 252nd Block) See Exhibit 11 A11 attached and made a part hereto. STREET IMPROViMENTS The improvement of 104th Ave. S.E. {aka Benson Highway) from the S.E. 242nd block to the S.E. 252nd block includes a 5 lane roadway with two-way turn lane, sidewalks, curb and gutter, drainage, underground1ng of electrical facilities and street lighting. Also included is a traffic signal at the intersection of S.E. 248th Street •. S.E. 248th will be realigned for approximately 675 feet east and west of 104th Avenue S.E. That portion of the nmprovements south of South 248th Street will be partially funded by the L.I.D. properties south of South 248th Street (i.e. those properties within the City limits). WATERMAIN Includes the installation of 8-inch stubs from the existing main to the right~of­ way at various points within the project limits and extension of the water main on the side streets to the limits of the new street construction. Also a11 water services within the project limits currently connected to the East Hill Community Well Company main will be replaced and connected to the City of Kent main. The cost of the 8-inch water stubs are being assessed tota11y under the L.I.D. to benefiting properties whether inside or outside of the City limits. SANITARY SEWER Inside City: From S.E. 248th Street to the south the existing sanitary sewer sha11 be stubbed out (6-inch stubs) to all unserviced properties within the street construction limits. A main line extension wi11 also be constructed at South 248th Street to provide service to the property at the southeast corner of 104th Avenue S.E. and S.E. 248th Street. Outside City: North of S.E. 248th Street a new 8-inch sanitary sewer and 6-inch stubs sha11 be constructed to provide sanitary sewer to al1 unserv1ced properties within the project limits.
