A RESOLUTION of the City Council of the City of Kent, Washington relating to agricultural land policy and endorsing the opinion of its City Attorney with regard to compensation for rezoning actions of the City. WHEREAS, the City of Kent has recently rezoned approximately 560 acres of land lying on the west and south sides of the Green River to an A-1 (Agricultural) zoning classification; and the City of Kent is now considering a proposal to rezone approximately 151 acres of land lying on the south side of the Green River to an A-G (Agricultural-General) zoning classification; and WHEREAS, the City Attorney of the City of Kent has rendered an opinion, dated 11-6-84, that concludes that granting I financial compensation to property owners for diminution of land values resulting from said rezoning, if any, would be unconstitutional; NOW THEREFORE THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council accepts and concurs with the opinion of the City Attorney dated 11-6-84 which states that any "compensatory" payment of money to a landowner for such an alleged diminution in property value would constitute a gift, and therefore, would be an unconstitutional and inappropriate act by the City.
