A RESOLUTION of the City Council of the
City of Kent, Washington on the appeal of Fred
Meyer, Ltd. from the decision of the Hearing
Examiner in # RZ-83-3. [FRED MEYER REZONE].
WHEREAS, on May 2 and May 23, 1984 the Hearing Examiner of
the City of Kent conducted hearings on the application of Fred
Meyer in Rezone Case No. 83-3, and on the related draft Environ-
mental Impact Statement; and
WHEREAS, on June 6, 1984 the Hearing Examiner issued her
FINDINGS AND RECOMMENDATION that the application for rezone should
be denied; and
WHEREAS, on June 20, 1984 the decision of the Hearing
Examiner was appealed to the Kent City Council by Fred Meyer, Ltd;
and
WHEREAS, on July 27, 1984 the Final Environmental Impact
Statement was issued; and
~ffiEREAS, the appeal of Fred Meyer was heard on proper
notice at the regular public meeting of the Kent City Council on
August 6, 1984; and
WHEREAS, the Council having determined to affirm the
decision of the Hearing Examiner; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY RESOLVE AS FOLLOWS:
Section l. The FINDINGS AND CONCLUSIONS of the Hearing
Examiner entered in her FINDINGS AND RECO~~ENDATION in Rezone
No. 83-3, dated June 6, 1984 and filed with the Council and City
Clerk, are adopted, and hereby are made the FINDINGS AND CONCLU-
SIONS of the City Council of the City of Kent.
Section 2. The application of Fred Meyer, Ltd. in Rezone
No. 83-3 be and the same is hereby denied. Said denial is without
prejudice and, pursuant to KCC 15.09.050 A.4., said application
shall be eligible for resubmittal.
