A RESOLUTION of the City Council of the
City of Kent, washington.
WHEREAS, Cornucopia Days has become a source of pride and
tradition for the City of Kent and its citizens; and
WHEREAS, the Cornucopia Days committee has requested
authorization for use of City streets, properties and equipment in
conjunction with Cornucopia Days 1983; and
WHEREAS, the Cornucopia Days committee has assured City
staff that arrangements have been made with affected property owners
concerning access to property during Cornucopia Days; and
WHEREAS, the City is mindful of issues of liability
arrising out of such activities; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
RESOLVE AS FOLLOWS:
Section 1. The City of Kent authorizes the Cornucopia
Days Committee (Committee) to use those streets, properties and
equipment, described in the attachment filed with the City Clerk,
and attached hereto, in conjunction with Cornucopia Days scheduled
from July 11th through July 17th, 1983. The Committee is further
authorized to post banners, as approved by the Director of Public
Works or his designee. The committee shall have exclusive right to
determine Cornucopia Days activities, including but not limited to,
concessionaires and booth locations and operations.
section 2. The Committee shall provide a dispute
resolution process to respond to complaints concerning operation of
Cornucopia Days, and shall process claims with all due diligence.
section 3. The Cornucopia Days Committee is authorized to
work in conjunction with other organizations in the sponsorship and
operation of Cornucopia Days. The Committee shall provide to the
City a certificate of liability insurance in a form satisfactory to
the City Administrator, naming the City, its elected officials,
officers, employees and agents, and hold the City harmless from all
claims arising out of the Cornucopia Days activities.
