HomeMy WebLinkAbout994RESOLUTION NO. ____ ~sr-·~2-~7·------- A RESOLUTION of the City Council of the City of Kent, Washington, conditionally endorsing the 1982 King County Comprehensive Solid Waste Management Plan. WHEREAS, the Washington State Solid waste Manage- ment-Recovery and Recycling Act, Chapter 70.95 RCH, requires all cities and all counties to have current comprehensive solid waste management plans; and WHEREAS, the City of Kent agreed on May 5, 1980, to participate with the King subregional Council of the Puget sound Council of Governments, the joint preparation of a revised Compre- hensive solid Waste Management Plan ("1982 Plan") under the provi- sions of RCW 70.95.080, and as contributed to the financial cost of the plan revision; and WHEREAS, the King Subregional council of the Puget Sound Council of Governments, which functions as the Solid waste Manage- ment Board with responsibility for comprehensive solid waste planning, has adopted the 1982 Plan; and HHEREAS, the public health and safety of the residents of King County and the City of Kent require safe and efficient handling and disposal of solid waste; and WHEREAS, the City has reviewed the 1982 Plan; and WHEREAS, the City agrees with the 1982 Plan findings that disposal sites in the county do not currently meet Health Department Standards, but disagrees that the violations of Health Department Standards at the Kent Highlands and Kent Midway landfills are "relatively minor;" and WHEREAS, the State has found in RCW 70.95.010(2) that "Traditional methods of disposing of solid wastes in this state are no longer adequate to meet the ever-increasing problem. Improper methods and practices of handling and disposal of solid wastes pollute our land, air, and water resources, blight our countryside, adversely affect land values, and damage the overall quality of our environment." And that these improper methods and practices of handling and disposal of solid wastes appear to be continuing with respect to the operations of the Kent Highlands and Kent Midway landfills; and WHEREAS, current information demonstrates that the continued maintenance and operation of the Kent Midway and Kent Highlands landfills are unacceptable and present a risk to public health and welfare; and WHEREAS, the 1982 Plan's Six-Year Implementation Program includes a section concerning the Kent Highlands and Kent Midway Landfill closure plans, and such closure plans having already been delayed beyond the dates set forth in the 1982 Plan, and such closure plans not assuring the immediate cessation of the use of the Kent Highlands and Kent Midway landfills in preparation for closure; and WHEREAS, the City finds that further use of the Kent Highlands and Kent Midway landfills should be ceased, and closure consistent with an acceptable plan be commenced with all due speed; and WHEREAS, by endorsing the 1982 Plan, the City neither accepts nor concurs in those portions of the Plan that allow for or condone continued operation of the Kent Midway and Kent Highlands landfills; and WHEREAS, a process to deal with emergency situations concerning solid waste management should be established; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES RESOLVE AS FOLLOWS: section l. The 1982 King county comprehensive Solid waste Management Plan ("1982 Plan") shall recognize all cities as imple- menting or operating agencies governing solid waste handling and the implementation of the Comprehensive solid waste Management Plan, pursuant to that authority granted in RCW 70.95.160. section 2. The 1982 Plan shall establish a goal to bring all landfills in the county into compliance with applicable health or other standards governing landfill operation, and to cease opera- tion of landfills operating in violation of such standards. section 3. The 1982 Plan shall provide for the immediate cessation of use of the Kent Highlands and Kent Midway landfills and shall provide for a more timely and accurate schedule for closure of those landfills. - 2 - section 4. The 1982 Plan shall provide for the establish- ment of a process to deal with the emerging issues or with emergency situations concerning solid waste management in the county. section 5. The 1982 Plan, with those conditions noted in Sections 1 through 4, above, is conditionally adopted as the policy guide for solid waste management in King County.
