HomeMy WebLinkAbout992RESOLUTION NO. A RESOLUTION of the City Council of the City of Kent, washington, relating to property acquisition for municipal and utility purposes. WHEREAS, the City endeavors to negotiate in good faith with those parties from whom the City seeks interests in real I property for purposes of municipal improvements; and WHEREAS, such interests in real property must necessarily be permanent, and unrestricted in nature in order to preclude potential for future unfunded liabilities on the City; and WHEREAS, it is in the public interest and to the benefit of the operating departments to have a policy governing acquisition of interests, less than fee, in real property; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON: Section 1. Permanent and unrestrictive rights in real property, not less than an easement, shall be obtained when it is necessary to acquire property for improvement of municipal utilities or other services. Section 2. Reasonable negotiations shall be conducted by such department, or designee, acquiring the property interest. such reasonable term shall be determined by the department head. Following the period of negotiation, the matter shall be referred to the City Attorney for preparation of an ordinance authorizing condemnation, or if such an ordinance has already been enacted, for proceedings in eminent domain. Negotiations may continue during the pendency of condemnation proceedings. Passed at a regular meeting of the City council of the City of Kent washington this~ day of April 1983.
