CIVIL SERVICE COMMISSION MEETING MINUTE$ t+

The regular meeting was called to order by Chairman T. Richard Ried at 8.00 AM.
In Attendance: Commission Members Michele G. Hinz and Joseph A. Street,
City Attorney Driscoll , Chief Angelo, Chief Frederiksen,
Captain Rees and Battalion Chief Fronsdahl
Also Present: Attorney William A. Coats, representing the City of Kent,
and Stuart P. Koch, representing appellant Pat Lowery, and
Pat Lowery. There were also personnel from the police
department and other departments present.
Chairman Ried announced the first order of business is the reading of the
Commission's decision on the Pat Lowery discharge by the Kent Police Department.
Mr. Ried read the entire document of the Findings of Fact, Conclusions and Order of
the Commission. The order reads that after investigation, this Commission finds
and holds that there was insufficient cause to support the discharge of Officer
Lowery, that he should be immediately reinstated as described in the Conclusions
and these Findings, Conclusions and Order be certified and provided to Chief
Frederiksen for his forthwith enforcement to RCW 41 .12.090, signed by T. Richard
Ried and Michele Hinz and dissenting vote by Joe Street. Mr. Street read his
decision.
The regular meeting resumed at this time. Mr. Street moved to approve the minutes
of June 16, 1988, as submitted. Ms. Hinz seconded and the motion carried.
City Attorney Driscoll told the Commission she can understand how difficult the
decision was and appreciates the time and hard work put forth by the Commission.
Chairman acknowledged that it was a difficult decision and praised the quality of
the legal work.
Chief Angelo reported he accepted the resignation of Lt. John Evans on July 7 and a
memo will follow. He also stated that the department will be requesting a
Firefighter exam at the August meeting.
A retyped Fire Lieutenant eligibility list, which was corrected and approved at the
previous meeting, was signed by the Commission members and copies distributed.
Mr. Street moved to approve payment of Ms. Howard's invoice for legal services for
the month of June, 1988. Ms. Hinz seconded and the motion carried.
Mr. Street expressed his concern, after completion of the lengthy hearing, that
provisions should be made in the next budget for reimbursement of Commission
members ' expenses, such as Ms. Hinz's babysitter expenses. Ms. Driscoll explained
that she has already someone in her office researching- such provisions.
The memo of June 17, 1988 from Chief Frederiksen, requesting removal of names from
the police officer eligibility list was read. It requested the removal of Marc
West based on background investigation and psychological report; Fred Parker, based
on background investigation and psychological report; and John Lind, based on
background investigation, psychological report and failure of his medical
examination. As the removal of the three applicants will deplete the police
officer eligibility list, Chief Frederiksen requested the list be formally
cancelled and he will advise the Commission of his intent to take immediate steps
to establish a new police officer eligibility list. Mr. Street moved to cancel the
present police officer eligibility list. Ms. Hinz seconded and the motion carried.
The memo of June 22, 1988, from Chief Frederiksen informing. of the promotion of
Officer Steve Ohlde to the rank of Sergeant, effective June 22, 1988, was read.
Mr. Street moved, Ms. Hinz seconded, to accept the memo into the records. Motion
carried.
Chief Angelo's letter to Lieutenant Kevin Kearns, informing him of his successful
completion of his probation and appointment to permanent status, effective the same
date was read. Also read was a letter to Lieutenant John Robinson informing him of
his permanent appointment to Lieutenant, effective the date of completion of his
probationary period. Ms. Hinz moved to accept the letter into the record. Mr.
Street seconded and the motion carried.
Copies of the memo from Chief Frederiksen to Officer Steve Tamanaha, regarding
disciplinary action, were previously provided to the Commission. Ms. Hinz moved,
Mr. Street seconded, to accept the memo into the record and the motion carried.
The memo of July 14, 1988, from Chief Frederiksen regarding the law enforcement
officer entrance test which he had reviewed with Acting Captain Mitchell and
Lieutenant Everett was read. The test met with their approval and could be
utilized for the next exam. Mr. Street moved to accept the memo into the record,
Ms. Hinz seconded, and the motion carried. Chairman noted the Commission needs to
review the test before approving the test. Secretary will request the inspection
copy for the Commission's review. Mr. Street moved to accept the memo into the
record. Ms. Hinz seconded, and the motion carried.
Chief Angelo's memo of July 20, 1988, regarding promotions was read. It informed
of the following promotions to the rank of Lieutenant, effective August 1 , 1988:
John Willits, Kevin Nee, Ron Johnson and John Keizer. Ms. Hinz moved, Mr. Street
seconded, to accept the memo into the record and the motion carried.
The next regular meeting is scheduled for 8.00 AM on Thursday, August 18, 1988, in
the Council Chambers.
