ORIGINAL CONTRACT DATE: 3/18/2024
This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Contractor shall provide all labor, materials, and equipment necessary to:
Accelerate work on concrete slabs to eliminate any scheduling impact as a result of
the timing of the delivery of final building forces, reactions, and locations of PEMB.
2. The total contract amount and time for performance provisions are hereby modified
as follows. This adjustment constitutes a negotiated sum wherein the City agrees to
pay the amount listed in consideration of Contractor's acceptance of the terms of this
Change Order:

3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
In accordance with Sections 7 and 8 of the Agreement's General Conditions, the Contractor
accepts all requirements of this Change Order by signing below. Also, pursuant to the Agreement,
Contractor agrees to abandon any protest and waive any claim it may have regarding the work
described in this Change Order and acknowledges and accepts that this Change Order constitutes
its final settlement and waiver of all claims of any kind or nature arising from or connected with
any work either covered or affected by this Change Order, including, without limitation, claims
related to material costs, contract time, contract acceleration, onsite or home office overhead, lost
profits, or any cumulative impacts of this and all other changes. This Change Order, unless
otherwise provided, does not relieve the Contractor from strict compliance with the guarantee and
warranty provisions of the original contract, particularly those pertaining to substantial completion
date. The City waives no rights, claims, or defenses through this Change Order, and does not
relieve the Contractor from strict compliance with its continuing obligation to provide a complete
project as detailed in the relevant plans and specifications contained within the Agreement.
Contractor's waiver shall explicitly include, but not be limited to, any and all claims related
to costs and delays associated or attributable in any way to the timing of Corona's delivery of final
building forces, reactions, and locations thereof stamped by a Washington State licensed structural
engineer and the City's finalization of its foundation design. This waiver shall apply to any and all
claims attributable in any way to this delay and requested acceleration of work, up to the
completion of the project, and including claims made or partially based on events occurring after
the September 19th, 2023 agreement between the City and Corona was assigned to Contractor.
The City does not waive any rights, claims, and defenses with regard to any claim or change order
request associated with the delivery of the final design documents.
Contractor's waiver shall exclude limited claims related to that are currently being discussed
with the City directly related to the 2nd floor admin staircase floor deck under ship ladder. The
City's agreement to this exclusion does not admit fault or responsibility on behalf of itself or any
third party and does not waive any right, claim, or defense as to this pending issue.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
