Jensen Department: HR Contract Amount: Approval Authority: ❑ Director ❑ Mayor ® City Council Other Details: REOEiVED MEMORANDUM OF AGREEMENT By And Between The MAR 15 2018 CITY OF KENT and Human Resources KENT POLICE OFFICERS ASSOCIATION City of Kent Representing the POLICE SERGEANTS AND OFFICERS Regarding Subsection 4.7.2 Standby for Duty (Detectives) This Memorandum of Agreement ("MOA") is entered into by and between the City of Kent ("the City") and the Kent Police Officers Association, representing the Police Sergeants and Officers' bargaining unit (referred to herein as "KPOA"), to increase the number of detectives placed on the weekly standby for duty rotation. Background The City and the Union are parties to a collective bargaining agreement ("CBA") effective January 1, 2016, through December 31, 2018. The parties' CBA currently provides at Section 4.7.2 that two detectives will be placed on the weekly standby for duty rotation, along with one investigations sergeant. However, due to recent trends in criminal activity that have been characterized as being gang related, the Kent Police Department has identified a need for a Special Investigations Unit (SIU) detective to be included within the weekly standby for duty rotation, increasing the total number of detectives required to three. This MOA amends the CBA to implement this change. Agreement The parties agree as follows: 1. Subsection 4.7.2.B.1. and 4.7.2.B.2 of the CBA are amended as follows, and the remaining provisions of Subsection 4.7.2 remain unaffected by this MOA: Subsection 4.7.2.113. Standby for Duty (for Detectives) B. To facilitate the standby process for Detectives, the parties agree to establish a standby program as follows: MOU Regarding Subsection 4.7.2 Standby for Duty (for Detectives) Page 1 of 2 1. Three (3) Detectives and one (1) Investigations Sergeant will be placed on standby (call-out duty) for a one-week rotational basis, those on the call-out duty shall move to the bottom of the rotation after their week; 2. The four (4) employees listed above are responsible to remain fit for duty and be located within a reasonable distance from Kent Police headquarters in order to respond to call back within a reasonable period of time (i.e. within an hour); 2. All other language of the CBA shall remain in full force an effect, and shall not be altered by this MOA. 3. This MOA was prepared and/or reviewed by both parties. In the event of an ambiguity in any term of this MOA, it shall be interpreted evenly, and not against the drafter of the MOA. The principle of contra proferentem shall not apply. By signing below, the parties agree that the above represents the parties' full and entire agreement with respect to the subject matter of this MOA, and this MOA shall be deemed executed and effective as of this _2-11*7-d-ay of March 2018.
