Background The City and the Union are parties to a collective bargaining agreement effective January 1, 2017, through December 31, 2019. At Appendix A, the CBA specifies target adjustments to be made on July 1, 2017, and January 1, 2018, to a number of position classifications based upon a salary survey study conducted in 2016. Target adjustments were mutually agreed upon by the parties and were based upon a market average that included cost of living increase of 2.5%. For example, if the average market comparison indicated that a position range should be increased by 5%, the cost of living increase of 2.5% was included in that 5% calculation, resulting in a market increase of 2.5% and a cost of living increase of 2.5% for a total 5% increase. In a subsequent salary survey for non- represented positions, the cost of living increase was not considered in determining the appropriate market adjustment to the position. For example, if the market average called for a 5% adjustment to the non-represented position, the position received the 5% adjustment, and the cost of living adjustment of 2.5% would be added to that 5%market average adjustment for a total adjustment of 7.5%. The adjustments made pursuant to this MOU are agreed upon in order to ensure consistency between the survey conducted for Union positions and the subsequent survey conducted for non-represented positions. This MOU was prepared and/or reviewed by both parties. In the event of an ambiguity in any term of this MOU, it shall be interpreted evenly, and not against the drafter of the MOU. The principle of contra proferentem shall not apply.
