A. Community Events
Council President Boyce announced upcoming events at the accesso ShoWare
Center.
Councilmember Fincher announced upcoming recycling events and Spotlight

B. Public Recognition
i. Employee of the Month
Mayor Ralph recognized Jan Hiatt as the City's February Employee of the
Month.

Human Resources Director Holly Harvey-Smith expressed words of
appreciation for Jan and her exemplary work.
ii. Proclamation for Black History Month
Mayor Ralph presented the Proclamation for Black History Month to Gwen
Allen-Carston, Executive Director of the Kent Black Action Commission.
Allen-Carston expressed words of appreciation for the Proclamation.
iii. Recognition of Adopt-a-Street Participants
Conservation Coordinator Toni Donati recognized all of the Adopt-a-Street,
Adopt-a-Spot participants, reviewed 2023 program and celebrated those that
participated in the program.

C. Council Procedures
i. Oaths of Office for Recently Elected Councilmembers
Mayor Ralph conducted the swearing-ins of Councilmembers Boyd, Boyce,
Larimer and Michaud.
ii. Election of Council President
Mayor Ralph expressed words of appreciation for Councilmember Boyce
serving as the Council President.
MOTION: I move to elect Satwinder Kaur to serve a two-year
term as Council President.

S. REPORTS FROM COUNCIL AND STAFF
A. Mayor Ralph's Report
Mayor Ralph provided a legislative update.
B. Chief Administrative Officer's Report
Chief Administrative Officer Pat Fitzpatrick advised staff are meeting with a
federal consultant for federally funded projects. Staff will bring a presentation
to the Council on three requests: (1) public safety technology; (2) Kent
School District and local colleges; and (3) a capital program improvement
involving Kent Schools.
There is an executive session this evening that is expected to last 10 minutes
regarding current or potential litigation.
Fitzpatrick advised his written report is included in today's agenda packet.
C. Councilmembers' Reports
Kaur serves on K4C and advised they monitoring current legislative bills.
Kaur advised K4C is receiving $85M from the Commerce Department for
electric charging stations - several which will be located in Kent.
Kaur serves as the chair of the Puget Sound Clean Air Agency that is
monitoring current legislation.
Councilmember Boyce provided a recap of the Operations items from today's
Committee of the Whole and Workshop presentation regarding the Kent East
Hill Operations Center.
Councilmember Troutner serves as the subject matter chair for the Economic
and Community Development items on the Committee of the Whole and
provided a recap of the LTAC Grant recommendations.
Councilmember Michaud serves on the King County Regional Law, Safety and
Justice Committee that advised the closure of the juvenile detention center is
being pushed to 2028.

Michaud serves as the Council liaison on the Human Services Commission
that recently appointed Gwen Allen-Carston as the Chair. The Commission
heard a presentation from Eileen and Callie's Place that provides support,
mentors, and relationships for girls that have aged out of the foster system.
Finally, the Commission discussed the grant application process.
Fincher serves as the subject matter chair for the Public Works items on the
Committee of the Whole and provided a recap of today's agenda items.
Fincher serves on the King Conservation District and announced the
upcoming plant sale and indicated the election closes on February 131". Visit
KCD.org to cast your ballot.
Fincher serves on the Mental Illness and Drug Dependency Council and
advised the Council is reviewing how to spend underspent funds.
6. PUBLIC HEARING
A. Public Hearing on an Ordinance Adopting Amendments to the
Building and Fire Code
Mayor Ralph provided an overview of the public hearing process and opened
the public hearing on the Ordinance Adopting Amendments to the Building
and Fire Code.
Deputy Director of the Economic and Community Development Department
Matt Gilbert gave the staff presentation on the Ordinance Adopting
Amendments to the Building and Fire Code
Gilbert advised the Wildland Urban Interface code is a new state building
code that takes effect on March 15, 2024.
The Code requires enhanced fire protection for buildings near forested areas.
• Wildland areas in Kent are mostly undevelopable
These requirements have very limited impact
• Applies only to new construction
2,332 impacted parcels
Mostly parks, wetlands and steep slopes where development is already unlikely.
• Requires exterior materials to be fire resistive, which is a common practice
already.
There were no questions from the Council.

Amendment to the License Agreement with Thunderbird
Hockey Enterprises, LLC, subject to final terms and conditions
acceptable to the City Attorney.
D. Consultant Contract Amendment for 2024 Comprehensive Plan
Update - Authorize
MOTION: I move to authorize the Mayor to sign Amendment
No. 1 to the City's contract with MIG, Inc., subject to final
terms and conditions acceptable to the Economic and
Community Development Director and City Attorney.

E. Grant Acceptance from King County Parks Levy Grant Program -
Boeing Rock Recreation/Habitat Enhancement - Authorize
MOTION: I move to authorize the Mayor to accept grant funds
from King County in the amount of $200,000 for the Boeing
Rock Recreation and Habitat Enhancement project, amend the
budget, authorize expenditure of the grant funds, and authorize
the Mayor to sign the grant agreement subject to final terms and
conditions acceptable to the City Attorney and the Directors of
Public Works and Parks.
F. 3845 : Grant Acceptance from Salmon Recovery Funding Board
- Boeing Rock Recreation and Habitat - Authorize
MOTION: I move to authorize the Mayor to accept grant funds
from the Washington State Salmon Recovery Funding Board in
the amount of $255,319, for the Boeing Rock Recreation and
Habitat Enhancement project, amend the budget, authorize
expenditure of the grant funds, and authorize the Mayor to sign
the grant agreement, subject to final terms and conditions
acceptable to the City Attorney and the Directors of Public
Works and Parks.
G. Grant Acceptance - Commute Trip Reduction Program -
Authorize
MOTION: I move to authorize the Mayor to accept grant funds
from the Washington State Department of Transportation, in
the amount of $161,600, amend the budget, authorize
expenditure of the grant funds, and authorize the Mayor to sign
the grant agreement, subject to final terms and conditions
acceptable to the Public Works Director and City Attorney.
H. Goods & Services Agreement with Olympic Environmental
Resources, Inc - Authorize
MOTION: I move to authorize the Mayor to sign the Goods &
Services Agreement with Olympic Environmental Resources,
Inc., subject to final terms and conditions acceptable to the

MOTION: I move to authorize the Mayor to accept grant funds
from the Washington State Department of Ecology in the
amount of $130,000 to help implement the National Pollutant
Discharge Elimination System Program, amend the budget,
authorize expenditure of the grant funds, and authorize the
Mayor to sign the grant agreement, subject to final terms and
conditions acceptable to the City Attorney and Public Works
Director.
J. 2024 Sub-Regional Opportunity Fund - Earthworks Canyon
Sediment Pond Culvert Replacement - Authorize
MOTION: I move to authorize the Mayor to sign all documents
necessary to accept funds from the King County Flood Control
District Sub-Regional Opportunity Fund, subject to final terms
and conditions acceptable to the Public Works Director and City
Attorney.
K. Termination of Easements and Acceptance of New Water Utility
Easements - Authorize
MOTION: I move to authorize the Mayor to sign all documents
necessary to terminate existing easements and to accept new
water utility easements in exchange, subject to final terms and
conditions acceptable to the Public Works Director and City
Attorney.
L. Accept the 2022 Sewer CIPP Lining Project as Complete -
Authorize
MOTION: I move to authorize the Mayor to accept the 2022
Sanitary Sewer CIPP Lining Project as complete and release
retainage to Insituform Technologies, LLC upon receipt of
standard releases from the State and release of any liens.
M. Accept the 2023 Plastic Markings Project as Complete -
Authorize
MOTION: I move to authorize the Mayor to accept the 2023
Plastic Markings Project as complete and release retainage to
Specialized Pavement Marking, LLC upon receipt of standard
releases from the State and release of any liens.
N. Cooperative Purchasing Agreements for Firearm Equipment and
Supply Needs - Authorize
MOTION: I move to authorize the Police Chief to purchase
firearm equipment and supplies through any of the cooperative
purchasing agreements the State of Washington has entered
into under Statewide Contract No. 22422, within budgets
previously established and approved by Council and throughout
the term of the state's contracts.

O. Third Amendment to Agreement with Axon Enterprise, Inc. -
Authorize
MOTION: I move to authorize the Mayor to sign the Third
Amendment to the Master Services and Purchasing Agreement
with Axon Enterprise, Inc., subject to final terms and
conditions acceptable to the City Attorney and Police Chief.

A. 2023 City Safety Road Diets Bid - Award
Public Works Director Chad Bieren presented details on the City Safety
Road Diets Bid and recommending awarding to Specialized Pavement
Markings, LLC.
MOTION: I move to award the 2023 City Safety Road Diets
Project to Specialized Pavement Marking, LLC in the amount of
$1,106,710 and authorize the Mayor to sign all necessary
documents, subject to final terms and conditions acceptable to
the City Attorney and Public Works Director.

Doolittle Construction, LLC in the amount of $797,037.50 and
authorize the Mayor to sign all necessary documents, subject to
final terms and conditions acceptable to the City Attorney and
Public Works Director.

MOTION: I move to award the Mill Creek/761h Avenue S. Culvert
Improvement Project to Active Construction, Inc. in the amount
of $13,824,824.01 and authorize the Mayor to sign all
necessary documents, subject to final terms and conditions
acceptable to the City Attorney and Public Works Director.
