5. Public Hearing on Amendments to Title 15 to address Behavioral
Health Facilities
At the Land Use and Planning Board meeting, members were briefed on
zoning code changes to Title 15 relating to behavioral health facilities.
Lindsay Walker gave a presentation of the changes proposed by staff to
update those zoning districts that allow the expansion of locations for Opioid

Treatment Programs and to add Enhanced Service Facilities and Behavioral
Health Treatment Facilities to the City of Kent land use table.
After the presentation, Board Members had a few questions. Clarification was
requested regarding whether grants from the Department of Commerce
entitle an applicant to guaranteed approval of a use by Kent. Lindsay Walker
stated that they do not, and that any project will have to comply with Kent
City Code. The second question was regarding children's facilities and where
they are listed in the code. The code does not differentiate between adult or
youth facilities, and they would both fall under the code.
The hearing was opened up for public comment. The only speaker was
Emanuel Shevchenko of Evergreen Haven. He wanted to encourage the
board members not to cherry pick through the Department of Commerce's
guidelines. He stated that the Department of Commerce was not against
locating these facilities in a low-density neighborhood.
There were no other public comments. Kristen Holdsworth clarified that the
Department of Commerce provides strong guidance that these facilities are
meant to transition from large hospital settings to smaller, community-based
locations. She stated Commerce has reiterated that they should not be
located in low-density residential neighborhoods because of compatibility
based on the amount of patients, staff, and family visiting.
MOTION: I move to recommend the City Council adopt the proposed
amendments to Title 15 addressing behavioral health facilities as presented
by staff, subject to revisions during ordinance drafting and review by the City
Attorney.
