This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:
Add additional quantities to bid items #3015 and #4010. Create new
pay item for removal and disposal of existing roadway to a depth of 6
inches; cost include removal, haul and disposal of exisiting HMA and
subgrade.
2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement, which will
become effective on the last date written below.

I. Proposed Change
Add additional quantitites to bid items # 3015 and # 4010. Create new pay item for removal and
disposal of existing roadway to a depth of 6 inches; costs include removal, haul and disposal of existing
HMA and subgrade.
II. Reason and Background for Change
During installation of the sheet pile wall on Kennebeck Ave the existing roadway was damaged. The City
decided to revise the original paving plan by deleting the planing and changing the roadway section. The
new section will consist of removing 6" of depth on the existing road and replacing with 3" of crushed
rock and 3" of HMA. The new bid item will include the removal, hauling and disposal of the existing HMA
and subgrade. The HMA will be placed in one 3" lift.

The contractor has agreed to complete the revised paving section on Kennebeck Ave utilizing
applicable unit prices that exist in the original contract plus a proposed unit price for asphalt
removal/roadway ex. Following is a summary of the premium cost we will be paying for the
completion of this revised section:
Increase in BI 3015 HMA Quantity (3" section): 125 tons (200 tons less 75 tons in the bid
items) @ $175.00/tn = $21,875.00

Strickland has agreed to honor the original bid price for the HMA. Here is a breakdown of the
estimated paving for Kennebeck:
HMA 200 tons @ $175.00= $35,000.00
Asphalt removal including haul 1250 SY @ $18.94= $23,675
Base Course 175 tons @ $63.00= $11,025
Total $69,700.00
Since we have decided to remove the existing roadway the $10,800 for planing will not be used.
Please let me know if we want to proceed.

After discussion with Jason this morning to expedite this section Strickland and Sons is agreeable to revert the Asphalt
Price back to the Original bid price on the bid schedule for HMA and will absorb the loss in this section based on price
changes from the original Determined low bidder at time of Bid See Attached Quotes received Before Bid and Received
after award just so everyone understands that because the Low Bidder failed to honor their Quote Strickland and Sons
moved to the next lowest.
Steel Sheet for a 6'x5'steel Sheet will be$3,100.00 plus T&M rate of install to fill gap left with the stationing issue in the
design.
Hopefully we can move forward in an expedited fashion I have the Paver rescheduled for week after next Week of the
215Y Weather permitted.
