HomeMy WebLinkAboutCAG2019-184 - Amendment - #6 - Sound Transit - Minor Revision FWLE-#06 (Exhibit K-7 or Exhibit G-LOC Right-of-way Cross Sections) - 8/12/24 MEMO T SOUNDTRANSIT August 12, 2024 TO: City of Kent; Kelly Peterson FROM: Sound transit: Linneth Riley-Hall SUBJECT: City of Kent Development Agreement—Minor Revision #FWLE-06(Exhibit K-7 of Exhibit G—LOC Right-of-Way Cross Sections)) Sound Transit and the City of Kent agree to a minor revision of the Federal Way Link Extension Project Development Agreement(GA-0274-17) between Sound Transit and the City of Kent("Agreement").This Agreement serves as a solution to the constructed location of walls R35-R.01 and R35-R.02. Minor Revision to Development Agreement Exhibit K-7 of Exhibit G—LOC Right-of-Way Cross Sections Exhibit K-7 of Exhibit G—LOC Right-of-Way Cross Sections Development Agreement directs the Contractor to install a 5-foot wide planter strip and 5-foot wide sidewalk along the west side of 26"Ave South and 281n Ave South in the Star Lake Station area. This minor modification allows for the narrowing of the planter width from 5.0 feet to 4.0 feet and keeping the 5-foot sidewalk width where the planter strip is adjacent to walls R35-R.01 and R35-R.02 as depicted on Attachment A to this agreement. This minor modification will also require street trees within the planter strips to be centered between the concrete curb and the sidewalk. Sound Transit and the City of Kent agree to these minor revisions of Exhibit K-7 of Exhibit G —LOC Right- of-Way Cross Sections to the Development Agreement. Minor revisions of the Development Agreement were anticipated as noted in Section 1.2.0. As required by Section 12.0 of the Development Agreement, these changes are necessary and consistent with the terms of the Agreement, the original scope and intent of the project,and are consistent with the minor modification criteria for development agreements in Kent City Code 15.08.4S0. This Agreement serves as concurrence between Sound Transit and the City of Kent regarding the planter strip width adjacent to walls R35-R,01 and R35-R.02. The city agrees that by constructing the improvements as provided in this Agreement, Sound Transit is meeting the intent of the Development Agreement. This Agreement shall be recorded in the same fashion as the Development Agreement at Sound Transit's expense.
