For Surplus of Retired K-9 Officer For and in consideration of my receipt of K-9 OFFICER Titus ("K-9"), who has been declared surplus to the needs of the City of Kent and the Kent Police Department, the undersigned, MATTHEW STANSFIELD, agrees to the following: I understand that K-9 has been specially trained to assist law enforcement in the apprehension and seizure of criminal suspects through the act of biting and maintaining that bite until ordered to release. Although K-9 has been specially trained, K-9 is an animal who, by its very nature is unpredictable and potentially dangerous, even when handled by trained personnel. I understand that due to K-9's special training and professional experience, K-9 has the potential to inflict severe injury or death to me; to another person, including a child; or to other animals. I voluntarily accept K-9, and I have signed this Release and Indemnification so that I may receive K-9. I understand that I can choose not to sign this Release and Indemnification and, therefore, choose not to receive K-9. The choice is entirely mine, and I accept K-9 knowing and assuming all risks, known and unknown. By accepting K-9 and signing this Release and Indemnification, I agree to hold the City of Kent, and any of its employees, officials, officers, or volunteers harmless from any and all injuries, death, damages, losses, claims, or other costs or conditions that may arise as a direct or indirect result of K-9. I assume sole responsibility for all of K-9's care and maintenance. I further agree to indemnify and defend the City of Kent and its employees, officials, officers, and volunteers from and against any and all claims for injury or loss, directly or indirectly attributable to K-9, including any claims that may be raised by a beneficiary, assign, dependent, family member, associate, agent, attorney-in-fact, or any other person or entity injured or otherwise damaged by K-9, whether or not such injury, death, damage, cost, or condition is caused by the negligent or reckless acts of the City of Kent, such that if any claim is filed against the City of Kent concerning K-9's actions after the date this Release and Indemnification is signed, I will completely defend such claim and will pay any and all judgments, damages, costs, fees, penalties, and attorneys' fees (including the attorneys' fees of the City of Kent), which may be ordered or available to such claimant. To summarize this section: If any person makes any claim that in anyway relates to K-9 and its conduct or actions after I have signed this Release and Indemnification, I will have no right to sue the City of Kent, and in the event any party who is damaged as a result of K-9 sues, I will pay any damages assessed against the City of Kent or its employees, officials, officers, or volunteers, and will also pay all costs and attorneys' fees for defending such action such that the City of Kent and its employees, officials, officers, or volunteers are not financially responsible to any person in any manner or under any circumstances. I have read, understand, and approve this Release and Indemnification, and I represent that I am authorized to enter into this Release and Indemnification, which is effective upon the last date signed below. All acts consistent with the authority of this Release and Indemnification and prior to its effective date are ratified and affirmed, and the terms of this Release and Indemnification shall be deemed to have applied.
