HomeMy WebLinkAboutCAG2021-296 - Other - Waiver of Bidding Requirements - Northstar Construction & Environmental, LLC - 6/2/21 KE14T POLICE DEPARTMENT W w.s« jtir.rcar Rafael Padilla, Chief of Police 220 Fourth Ave S Kent, WA 98032 253-856-5885 Memorandum To: Dana Ralph, Mayor Date: 06/02/2021 From: Christopher Sprague, Rangemaster/Training Coordinator Re: Request for Waiver of Bidding Requirements Pursuant to KCC 3.70.110 for firing Range Maintenance Pursuant to Kent City Code (KCC) 3.70.080, I am requesting that you waive the procedural requirement to solicit telephone/written bids or quotations, to enter a Goods and Services Ordinary Maintenance Agreement, in regard to the following facility. The City of Kent Firing Range is cleaned by a company that specializes in the deep cleaning of hazardous materials for health and safety reasons. We also hire the company to remove, replace and package the air system filters; a process that involves unique and special services, thus, the bidding requirements would not be in the City's best interests. This contract would expire after three (3) years. The range generates a hazardous material (lead) and is subject to the regulations set forth by the Environmental Protection Agency (EPA); Washington State Department of Labor and Industries; and Washington State Department of Ecology. For this reason, cleaning, and disposal of collected lead and other debris, must be consistent with the regulations set forth by the above-mentioned agencies. Due to the highly regulated and specialized nature of the process, the vendor must be Washington state certified for hazardous materials abatement. In 2013, the Kent Police Department selected North Star Construction and Environmental L.L.C. to perform ongoing cleaning and range maintenance. North Star Construction and Environment L.L.C. has done additional range renovation work to include grinding/refinished the range floors, repairs to the sound isolation system, drain decommissioning and HEPA filter rack repairs. This company's knowledge of our range systems is beneficial to the city as there is no learning curve that comes with a new vendor. It is worth noting that failing to follow regulations can lead to worker injury and/or death, environmental and public hazards and fines and imprisonment. Further, the generator of the waste can also be held liable for the contractor's actions. Memorandum: June 9,2021 Page: 2 This vendor has done an exceptional job with onsite safety, onsite regulation compliance, quality of work, scheduling flexibility, and proper billing. This company has continuously maintained proper insurance requirements for city work. We have had a maintenance contract (expired) with North Star Construction and Environmental L.L.C. in the past and would like to renew this for ease of scheduling and time management. KCC 3.70.110(A)(2) &(A)(3) allows the Mayor to waive the bidding requirements for the purchase of goods, materials, equipment, or services that are not part of a public work upon a finding that the bidding requirements would otherwise not be practicable or in the City's best interests under the circumstances. Because North Star Construction and Environmental L.L.C. has provided excellent safety, service and adherence to regulation, I believe it is in the City's best interest to directly negotiate a services agreement with North Star Construction and Environmental L.L.C. and request that you authorize the waiver of the bidding requirements. If you concur, please indicate your approval and waiver of bidding requirements by signing where indicated below.
