This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
As described in attached Exhibit A, incorporated herein, the contractor shall provide all labor and
material to tint to the existing benches during finishing
2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement, which will
become effective on the last date written below.

SUBJECT: City of Kent Courtroom Refurbishment Change Order —
Authorize
MOTION: I move to authorize the Mayor to sign Change Order #6 with LBC
Construction in the amount of $20,419.16, subject to final terms and
conditions acceptable to the City Attorney and Parks Director.
SUMMARY: The project involves work at the existing site of the City of Kent
Municipal Courthouse. It includes the demolition and reconstruction of the
courtroom dais in all four courtrooms, raising areas of the room including the jury
box and dais, and adding a new spectator rail between the gallery and well. The
installation of new carpeting throughout the four courtrooms and modifications to
existing audiovisual systems are also part of this project.
The contract was subsequently amended through prior change orders to add
upgrades to three jury rooms, add lawyer tables, adjust the 2024 tax rate change,
paint the ceilings in the four courtrooms, and add and reroute electrical conduits
and outlets. This Change Order 6 is needed to add tint to the existing benches
during finishing.
The contract was initially authorized in the amount of $678,216.00. The Mayor was
able to sign previous change orders as authorized by Chapter 3.70 of the Kent City
Code. However, the aggregate amount reached with Change Order 6 requires
Council authorization. There are sufficient funds within the capital budget to cover
the cost of this change order.
BUDGET IMPACT: Extra expenses will come out of the capital budget.
SUPPORTS STRATEGIC PLAN GOAL:

and technological infrastructure.

Kent Municipal Court Refirbishment
ASSUMPTIONS&EXCLUSIONS
The plan or specs do not call out for a stain color,thus on phase 1 we refinished and reapplied the original stain.This
stain did not match the new stains in the courthouse and it was requested that we restain the benches.
We decided to only charge for the Phase II to share the extra cost with the owner.This extra staining process will take
an additional two weeks to finish,thus LBC is requsting a time extention of 10 days.
